My wife already has her 10 year green card (GC), but because her son entered later, we were not able to include him at the time of her mom's removal of condition. I was reading the I-751 instructions, and it somehow states that by including her son (my step-son) in her I-751, his removal of condition will be done too. Here it is the exact text in the I-751 form:

Who May File Form I-751?

If you were granted conditional resident status through

marriage to a U.S. citizen or permanent resident, use this form

to petition for the removal of those conditions. If you have

dependent children who acquired conditional resident status

concurrently with you and entered the United States within 90

days of your arrival, then include the names and A-Numbers

of these children in Part 5 of this form in order to have their

conditional status removed. If you have dependent children

who acquired conditional resident status after 90 days from the

date of your adjustment or if the conditional resident parent is

deceased, then those dependent children must file Form I-751

separately to have their conditional status removed.

Thus, based on the above statements, I don't know if I should filled another I-751 for my stepson or if I should use a different form which is not explain within these instructions. Let me know if you need more info from my case to guide me here. My stepson's removal of conditions are due to be submitted at the latest on July 15th, but I would like to see also what other documents should be included since his case is different from any others here. I am totally confused now. Thanks.

I am currently going through the same type of situation as well...to answer your question, if your son entered 90 days or more after your wife, then you will have to file another I-751 for the son,along with the proper filing fees, as far as what documents to provide for evidence, I plan on sending report cards from his school...that should be more than enough seeing how the mom already has been approved in your case...good luck...

Thanks for your answer. Yes, he entered more than 90 days after her mother, now my wife with the 10 year green card. He is 21 years old, and he is only study at a City College and eventually transfer to a 4 year college if there is money to pay for college which seems to be getting more expensive every few months. I guess I may send the report from city college is there is one, and add a few other things including a photocopy of her mother's green card. Thanks again.

Thanks. The first thread has a more organized description of the problem and its solution. It is better explained there. The second thread was not very helpful, but thinks for finding them. I guess I know what to do.
