Should we get married in the US or France?

Timeline

I'm an American living and working in the US. My fiancee is Algerian, living and working (legally) in France. Our end goal is to get married, live and work together in the US.

Should we A) Go the K1 / Fiancee Visa route and petition to get married in the US? or B) Go the K3 route, get married in France, then petition for her Visa to the US?

Initially we were thinking a French marriage would speed things along, but I'm not sure...

Any insight would be appreciated!

some people will choose K-3 as may cost you a few hundred dollars less.. But the process may take a little longer..

I personally decided to go with the K-1.. that option gives me 6 month from the time of entry to handle all my affairs and a bit of time to learn about each other when living together.

I don't know how a marriage would "speed things up". (K-1 vs K-3/CR-1)

The real question is how soon will she want to come to the US?

If it's more than two years, I would recommend getting married there, when your ready to bring her over, you would file for the IR-1 (10 yr card). (of course, being seperated for 2 years, being married, might be to much to ask)

If it's less than two years, then you either can go with the K-1 or the CR-1 - your choice - they have different costs/waits, but you have to compare (there is a link above that does that for you) - I would go for the K-1.

(in fact, I did the K-1 for my Fiancee)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You might want to consider DCF ( Direct Consular Filing ), you get married there and file the I-130 at the consulate, bypassing USCIS. There is a whole section here on that and VJ info and a DCF forum.

Thanks! I'm leaning towards K1.

As for DCF, according to my research you both have to be living in the country.

Oops sorry, my imagination must be making me read imaginary things in the morning :blush: I realize now that you're not living in France. So yes you are right K1 makes sense.
