Bringing Nephew to US

My husband came here on a K-1 visa and now we want to adopt his nephew and bring him over here as well. We didn't put his nephew on any of the paperwork during the K-1 process because he wasn't adopted yet. Is this even possible to do? His nephew has both parents living but his mom is out of the picture and his dad could care less, and in fact will have no problem releasing parental rights. My concern is about USCIS and how that will all work. Any ideas? Any info will be helpful. Thanks!

This will not work, because the child have both parents living. US will not acknowledge the adoption. sorry. All he can do at this time is try to support the nephew in his home country. He can finance the nephew thru boarding school and hope that his endowment will assist the nephew in doing great things.

Go to USCIS.gov and read up on adoption for more background information.

The child must be certified as an orphan, in this case both parents are alive.

Plus, the child has not been adopted, per the OP. They are looking for a waay to bring a relative to the US, and they wish to try using the adoption angel. Go to USCIS. gov and read up on the process of international adoption.

Life'sJourney is correct. Adoption where parents are living will not work for USCIS because people do this just to get relatives to the US. USCIS won't recognize the relationship.

Yes, both of his parents are alive but they have basically abandoned him. Wouldn't that be grounds for adoption?

Well, we thought it was worth looking into. My husband was pretty much the only male-figure in his nephews life and pretty much raised him so when my husband had to come here, it was really hard. We thought that it would be a way to re-unite them.

Too many people try adopting siblings and cousins and nephews to circumvent immigration law ( some even had the nerve to turn around and try to bring the bio parent based on the child being here ) . They are now very very strict that the parents be dead ( with only minor loopholes ) You can adopt him over there , but that doesn't mean that the adoption is valid of immigration purposes.

This will not be over quickly. You will not enjoy this.

For immigration purpose both the parents need to be deceased, ppl in past have faked the adoption between niece and nephews and other ppls kid to bring them over in US.

Hence no more adopted children are admissible unless both the parents are deceased.

They are more then welcome to adopt him in any country they like, they can be his legal guardians pay for his school and board etc, but when immigrating to US that adoption does not work.
