I have B1/B2 multiple visa and have been here in the US in 2009 for business as I was sent by my employer in the Philippines for training. Then, my husband and I were just chatting before like November 2010. He wanted to see me by December but my mom didnt allow me to coz its Christmas time so I came here January 2011. By that time, I was also laid off by the company.

I was stamped 2 weeks of stay here in the US and the purpose of visit is just to see him personally and visit some relatives and my other bosses. All the while we were expecting I will be given 6 months to stay but only 2 weeks and he proposed to me 2 days after. We got married on the 11th and filed all the paperworks on the 19th as Im so scared of the immigration policies here in the US so we filed immediately.

My papers are being processed so fast. I got my EAD by March and now our interview is by May 17. We consulted a lawyer ans he said she was abit hasty coz we got married within 30 days and they have a 30/60 days rule so both of us are so scared of the process.

She was charging us $1700 so she can appear with us on the interview and do some consultations too. She didnt make all the paperworks as my husband and I both did it based on what we researched on the internet.

Do you think I will be approved?

There is no such thing as the "30/60" rule.

Lawyers use this to try to "cover" the bases - they would rather you wait till your in country for a certain amount of time, so not to look like you came here with intentions of staying.

However, If you entered the US legally, and didn't misrepresent yourself, you are free to AOS if you meet all the requirements.

Will you get more scrutiny then someone who was here for a while? Maybe - but unless there are real issues - you shouldn't have any problems.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thats what Im thinking too. Do you have any experience of this? It wasnt really a fault to get marry so soon. When he proposed, I was actually planning in my mind my wedding in the Philippines but I was surprised he wanted us to marry in a courthouse. I am just scared of the interview or should we hire this lawyer to feel more ease.

Trying to understand.. currently you and hubby processed a petition to change your status as you got married.. You already received your EAD [Employment Authorization Document] but not your AP [Advance Parole or Travel Permit]..

If your paperwork is being processed and you already receiving answers, i quiet believe you dont need an attorney.. However, many people hired legal representation [which has no authority/power of any immigration laws] as of peace of mind.. but i am quiet sure you dont need it..

Many, Many VJs members can testify of processing their own interview and documents without any legal assistance.. In many occasions, attorneys make the interview a bit more complicated..

I have EAD, I also applied for Parole as we were planning to get married by June in the Philippines. But we cancelled it as we are both unsure if when are we getting schedule for interview.

The lawyer told me that the question will specifically be focused on my legitimate entry to the US which I am 100% sure I entered in good faith without thinking of getting married. But he was the one who was pushy to marry soon and he didnt want me back home.

We filed the forms before my I94 expiration date on 20th of January. Coz we want to make sure im not illegally staying as spouse of citizens are granted stay when they file for petition.

Im so scared. lol

Just relax and tell your story. Sounds like he, the USC, surprised you with a proposal. They will listen to you.

We didnt hire a lawyer. The papers were all prepared by both of us. We consulted one just last Saturday just to get some insights. But shes charging $1700. Thats a lot!

I will assume, you have extensive documentation of you ongoing relationship to the point of marriage, right? you did not just marry a person who you met two weeks ago.. Whether or not you got marry a day or 60 days prior, your will be providing documentation that will show legitimate actions, long term relationship, mutual financial relationship, etc, etc. If you dont have what the IO requires, a $1700 lawyer will not solve your case.

Definitely. I already printed all the chats and mails. And even the plane and hotel reservations he got for me. I also have the receipts for the gifts he bought me and my family on Christmas. I am also included on his medical/dental and life insurance plans. We have a family package phone bill and lots of pics.

This is just my opinion...I think it's wrong for people to try to game the system. You were planning on getting married and then you he suddenly popped the question and you got married. I wish the USCIS would stop people from adjusting when they come to the USA on a tourist visa with the intention to get married. And then you want people's advice on how to make sure you get to stay. Something is wrong with this picture.

Well, you have to understand that you did not follow the rules,now it's up to both of you on how you can get out from it,most of the immigration officer are very tough when it comes to interview like this,Be ready to answer lot of questions that the IO will ask you specially for the 5 days of marriage after your entry here in US.What is 1700 dollars if you really need helps to your case. I hope you will be approve good luck!
