At the 5 month mark - should I start calling or wait

Hi All,

We are at the 5 month mark, our NOA1 date is 11-29-2010, should I start calling, or continue to wait? The petition was touched Dec 7th and not a peep since then.

I have seen from other posters that the USCIS sometimes does not update the last update date very often so I not to concerned by the lack of activity, but, like lots of posters, we too want to move to the next step and get beyond the endless waiting.

Our NOA-1 date was 10-28-10 and we got NOA-2 from VSC on 4-22-11. I think that you will get it within the next 2-3 weeks. Hang in there.

This is really your decision, however I elected to call, I asked to speak with a Tier 2 and they put in a service request and 10 days later our file was approved. However, this does not always work. But just a suggestion

I actually marked 5months today and called VSC and they told me they are working on November 02 petitions and was able to put in a service request and will hear something in 15days..

Putting in a service request before your six month mark can be risky. If they even let you put one in, you may get lucky and it work in your favor. However if you put one in to early, they could give you a generic response of wait 60 days. If they give you that response, there is nothing anyone at USCIS can do to move your case along. my recommendation is to wait 2 weeks and then call your senator or us congressman and have them try to get expedited due to outside of normal processing time. That's if USCIS allows even them to request it. They my make you wait until 30 days after your five month mark before they will even consider the request from your representatives. Nobody knows what goes on inside ( Area 51 aka VSC ) to me it's like a chess game. If I could go back in time, that's how I would have done it. Good luck

hey.

in my experience calling doesnt do much.they always keep telling u the same like oh we late just wait and that.

our case was touched once and thats it and then after almost 6 month we got a email from them.

idk if it helps to contact a senator or congressman. i mean we did but b4 they could do something we just got our noa2.

i know it sucks BAD but in case contact ur senator or congressman and wait until 6 month. its the refualr process time these days.

i really wish you good luck and hope u guys get ur noa2 SOON...

I have looked on the timeline of VJers and have seen lots of people, with petitions in Vermont, that have been approved, and, they seem to be processing a little faster, so that is why I am wondering if we are facing a problem. It would be good if you could call and get an actual status as opposed to some canned responsed from a contractor. But what else can we do?

Is requesting a tier 2 any better?

BTW, the first time I called I didnt hear a promopt to speak to a representitve. What is the secret for talking to a live person?

What is the risk? It is either a yes or no. But I dont think they can "hurt" you - hold up your request just for asking.

Our timeline is similar to yours with NOA1 dtd 12/03/2010. I waited exactly for a week after our 5 month mark ie. 05/10/2011 and called the USCIS and put in the service request. The secret to get to the live person is - DO NOT PRESS ANY #S AFTER DIALING THE 800 NUMBER AND THEY WILL TRANSFER YOU TO THE LIVE PEROSN. :thumbs:

I am waiting for another week and then will contact the congressman/sensator to look into our case on 05/17 which would be 2 weeks after our 5 months mark. (I am really hopeful that I will get the approval before that :whistle: ) I know waiting is tough ..really tough...
