im a 20 year old canadian woman living in B.C and my fiance is an american living in the USA. we are planning on filing for a k-1 visa in the beginning of june 2011. and ide like to ask a few questions. my first question is, my fiance will be filing for the k-1 visa from west virginia, and im curious what USCIS centre it goes to, the one in Vermont or Texas? ive tried looking that up myself but I simply cannot find it on my own.

but also, my main and most important question is, can my fiance come and stay with me for a few months in canada while our k-1 visa is in process? not the whole time the visa is processing of course, but i mean about the 5-6 months he legally is allowed here in canada, that is if the immigration officers let him in for that long. The only thing i can think of why he wouldnt be able entry to stay here with me is, the immigration officers thinking he might not return to the USA OR the fact he wont have a job anymore from being away for so long. I know he will have to show proof of support for the k-1 visa for me, and he does make the required amount now with him working. we have thought of doing a k3 visa, BUT unfortunatly, my first and only time trying to go to the USA I looked too "suspicious" going to the USA because I guess I had so much baggage to visit him which I was unaware of, so I was red flagged and denied entry. So we are trying to do the k1 visa because I NEED a visa to have entry into the states now. but is there ANY way or route we can take to have him live with me for a few months, even if the visa isnt approved yet? i just need that comfort of being with him through that amount of time. any personal stories or any information would be GREATLY APPRECIATED! :(

I am under the impression that your fiance would be able to come and stay with you without affecting the K1 petition. Whether or not he violates any immigration laws while in Canada would probably be the only issue. You just have to file the K-1 in the US. After that he could stay with you the whole time if you wanted I assume.

Concerning where your petition will go, from what I can tell it will go to Vermont. Check out this discussion.

Yes he should be able to visit you while the 129f petition is being processed. I don't know about 5-6 months Lord how is he going to support you if he has no job here in the states? Visiting in my opinion should be for a holiday time of 4-6 weeks at a time. Not 5-6 months. We all have to be apart from our loved ones during this process and some on the other side of the world so you are not alone there. He needs to be working here in US as when your 129f is approved he has to show that he can support you when you arrive here. I would suggest if you want to be together then he needs to file sooner and get the ball rolling.
