My husband and I just received a RFE from USCIS. He was here 4 years ago on a J1 visa and was subject to the 2 year's rule. The RFE is to prove he fulfilled his requirement. They also requested his birth certificate.

I am very confused because they are asking for a photocopy of his J1 visa in the passport and the birth certificate. I already sent those in the original packet...I really don't understand what more they want. :bonk:

What should we send to prove he went back to Turkey and stayed for 2 years. He actually stayed longer than 2 years due to his job and army obligation.

Any advice will be greatly appreciated.

im sorry this happened

send what they ask for

send a copy of any stamps proving when he left america and went back to turkey

get any housing or bank documents or job documents to prove he was there

and maybe even military papers

anything that can show he left america and stayed in turkey for 2 years or more

Hi Esli,

Send exactly what the USCIS is asking for (copies of Birth Certificate & his J1 Visa in the Passport in colour copy). Then, to prove he did the 2yr requirement, his Army discharge papers, Affidavit from his employer, and do you have any letters he sent you via snail mail with the Turkish Official dated stamp on the envelope??? To further prove his fulfillment: I would Include all pages of his passport and his poice archives plus the police certificate -- current (even if you don't have to send this in till your packet 3 is sent to you).

PS: Don't forget when you send back the RFE:

A). Please include a cover letter stating contents of evidence and how many pages each. Be sure to state Petitioner & Beneficiary's names and your USCIS ID#

B). Copy (front/back) of the NOA1 as per the NOA1 instructions on the backside of this document.

C). Copy of the RFE from USCIS letter they sent you

D). All evidence as given

E). Send it back Certified Receipt Return so you know when they have it.
