Hi everybody, first sorry about my poor english. I need an advice if some similar cases. I married my wife at 2002th at 2005th she got her visas lottery but i was unable to travel with her to the states because the person who assisted her to applicate the DV lottery form made a big mistake when he mentionned her as a single, at her interview in the consulate they didn't ask her about her statut so she didn't lie. After many travels to the states my wife with my agreement decides one year to still at states until in join her. last month (april) i had the consulate interview but the consulate keep my passeport and all documents they said that they will do an investigation because they don't understant why my wife applied single, i explained to them that it was a mistake because my wife didn't speack english and was assisted by a bad assistant, they insisted on the investigation and told me that it will take max 4 month.

Pls if you know a similar case let me know the real timing of the investigation, the probal result, the investigation nature and if some way to expedie our case especialy we have a child who is 5 years old (born in America at 2006th) and who must start school asap.

Is your wife a citizen yet? Best thing I can suggest is for your wife to contact her Senator and have them enquire into the case. However...

Does your wife have a lawyer? She could be in serious trouble if they view her case as missrepresentation, as she didn't mention being married in her DV paperwork- this could affect not only you coming to the USA, but her status too.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I don't see how the child is a reason to expedite. The child was born in the US, and can leave or enter the US anytime (with a US passport), and can enroll in school in the US. If the child is currently with you then there is nothing preventing the child, who is a US citizen, from returning to the US to start school. You don't have to accompany the child. The child's mother can do that.

Your wife is responsible for every document she signed. It doesn't matter who filled out the form for her. It was her responsibility to make sure the information was correct, and she's the one who will be held responsible if it's not. Your best hope is that both the consulate and USCIS are willing to accept that it was an honest mistake. If they don't buy it, and determine it was a material misrepresentation, then your wife will lose her green card.
