My husband is a permanent resident who came on a K1 Fiance visa. He has been here 6 years. I as a US citizen will apply for my stepdaughter. (His daughter is now 15.) I was going to apply as I understand it is quicker than if he does it as a Permanent Resident. My question is though, since my husband immigrated here on a K1 Status sponsered by me, is it better to do the following to Join benefit? i was just going to file the I-130 and now im not sure since I read the following to join info. He did come here on a K1 Visa and my stepdaughter is under 18. Is that all we need to file under that? She was listed as his daughter on his K1 I-129F original packet. Anyone??? Kinda confused. Thanks.

Follow to join is a K2 visa. The applicant has to apply within 1 year of when the K1 received their visa. Your step-daughter is no longer eligible for a K2. However, since you married before she was 18 then she's eligible for an IR2. File an I-130.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
