TO ALL PINOYS OUT THERE I NEED YOUR HELP

This is my situation: I was born in the United States but my parents are Filipino; when i was still a baby they brought me back to the Philippines and I grew up there but my parents never made me a Filipino citizen; I was always American; I grew up in the Philippines and on October 2007 I gave birth to my son in the Philippines; I thought I was able to bring him with me to the United States with an American citizenship but that was not the case; I was not able to fulfill this one requirement for me to transmit my citizenship to him:

A child born outside of the United States to one U.S. citizen parent and one non-U.S. citizen parent may be entitled to citizenship provided the U.S. citizen parent, prior to the birth of the child, had been physically present in the United States or one of its outlying possessions for five years, at least two years of which were after s/he reached the age of fourteen.

Like I said I was born in the United States but I grew up in the Philippines; I never spent five years in the United States before the birth of my son but I had only gone back and forth to the United States for summers and holidays;

So I left my son when he was only 8 months old to start a life here in the United States; I have been here almost 3 years; I made myself quite stable and I have been working on his papers to come here; As what I have researched the only possible way is for him to come on a cr-2/ir-2; uscis has already approved that petition and his paperwork is already with NVC; I left my son in my mothers care; i know right, isnt that a good thing, he is with his "lola" and who better can take care of him while he is not yet here with me? but wrong, I am going through a divorce with my sons father - yes i petitioned him and yes my soon to be ex husband came here on a CR1; our divorce is almost final too.

my problem is my sons visa; i entrusted my parents to apply for him and it has been almost one year for that passport application; i understand that there are complications because I am not filipino and my sons father was also a foreigner living in the philippines; all the paperwork has been submitted; I even went to the philippine consulate to notarize all the paperwork that DFA Wanted and gave it all to me parents so they process it; I have given them all the paperwork since august 2010; almost one year and no passport; my mom keeps telling me that its still processing; she and i are not in good terms and she is keeping me from my son; before when i was still in my marriage she lets me see my son on webcam and would write down my sons activities for the day from his playschool and all; now it takes days before she answers my email; and all she ever writes is he is doing fine and sends some pictures here and there; she is mad at me because i am trying to move on with my life and meeting new people - what else is someone suppose to do when they get divorced? i have always supported my son - send him monthly allowances and pay for his schooling and his nanny,

i need help in getting his passport; i have called DFA but its so hard to get through on the phone; i am about to just ask someone to go there themselves and ask about the process of my sons passport; please help anyone...his petition is all set here but of course for him to travel and have the visa stamped he needs a passport; i am depressed and devastated by all this; i worry day and night not knowing about my son; and at the same time i cant just fight my mother bec after all she is my mother and i am scared she will never let me know about my son; it would be such a scandal if i just show up and pick my son up in the philippines after all i have every right to bec i am his mother but i know my mother will create some drama scene...

I suppose you could go to the Philippines, pick up your child, apply for another passport at the DFA if the one they issued was lost or stolen, take the passport to the embassy to get the visa issued, and bring him back to the US to live with you. Can't really tell you how to handle your own mother. Sometimes if you want something done right, you've got to do it yourself.

hi, i think you would really need to go there in the Philippines if your mom is not cooperating. they require personal appearance for either parent or guardian for the passport application. you can read it from their website: http://epassport.com.ph/requirements

or perhaps you can go to or call the nearest Philippine Embassy in your area to directly inquire about your situation.
