I am the USC and my husband is the LPR; his 2 year greencard will expire in march 2012; our divorce is almost finalized; just a few more paperwork and a courtdate and it will be final; my question is how will he be able to renew his 2 year conditional greencard? it has been 7 months since he left the house and picked up only his paperwork and nothing of our marriage except maybe some pictures in his ipod; social network etc; we have talked a couple of times via phone; email and just could not work it out; do i have to play a part in his processing? i do not want to be charged w/ any type of fraud; basically he left and i really do not want anything to deal with him really anymore; plus we have a child and our child is still in the philippines with my mother and i am still working on his paperwork to come here; my soon to be ex has signed full and legal custody to me. my son is almost 4 years old and all those four years i have worked and support him financially and everything; how will this play out? thank you all.

He can either go back to his home country when his CGC expires or he can lift the conditions by himself. You dont have to do anything to help him if you dont want to.

He needs to gather paperwork to show that your marriage was enetered in good faith eg rental agreements, mortagage agrements, birth certificate of your child you had together, bank staements, joint tax forms etc etc

The more paperwork the better. Once he has collected various things such as this he sends it off and then its up to the IO if they believe that the marriage was in good faith and if they want to approve it or not.

You dont have to do anything if you dont want.

If he only has ipod pictures then I would say his chances of having his ROC lifted are pretty slim as this is not enough evidence. They are more looking into if you mingled finances as if it was a fraudlent marriage, who is gunna want to mix finances together??any one can take a few pics here and there. But let him worry about all of that stuff and just worry about how to get you child here :)

Pictures are fine. Does he know anyone that can witness you two were a couple in the US even though not for long? I went through the same process, very similar situation than you and husband, and got approved last week! I don't know whether being from Italy played a part, but it ended well and I am happy! :)

12/07/2009 - I-130 and supporting documents sent to USCIS office in Rome

12/16/2009 - USCIS office received the form

02/16/2010 - NOA1

02/22/2010 - I-130 Approved

05/27/2010 - DS-230 sent

07/19/2010 - Medical exam in Napoli

07/20/2010 - Interview
