Hey guys,

quick questions if anyone can help. Thank you in advance.

I am currently in the US on an F1 student visa, I have been here for almost 3 years now. My husband and I got married, he is a US citizen.

From this information could someone advise me on the following;

G325A Biographic Information:

Q) this form is submitted in connection with an application for:

1) Naturalization

2) Status as a permanent resident

3) Other:(specify)

I think the answer is 2. Or do I put 3, other because i am applying for a K3 visa?

and then secondly,

I-485 Application to register permanent residence or adjust status

Q) I am applying for an adjustment to permanent resident status because:

1) An immigrant petition giving me an immediately available immigrant visa number that has been approved

2) My spouse or parent applied for adjustment of status or was granted lawful permanent residence in an immigrant visa category that allowed dervative status for spouses and children.

I think the answer to this one is 1.. if anyone can confirm this??

Which of those two questions are my answers??? HELP someone!! THank u!

If you are in the US currently as an F1, got married to a US citizen and are applying for a green card in the US, then you are not doing the K3 process - you are doing adjustment of status (AOS) from F1 to legal permanent resident. K3 is a spousal visa that you apply for when the foreign spouse is abroad. When you are already in the country with a non-immigrant visa, you do not need a spousal visa, you apply directly for green card.

In this case, the question on G325-A is no. 2, and for the I-483 it is 1. You should be posting in the Adjustment of status from work, tourist or student visa-forum, you will get more replies there.

One note: I believe adjusting from a F1 requires a concurrent I130 application, just as adjusting from a K1 does if you wait "too long" to adjust.

Yes - so just to make sure you are looking at the right process, Ally1389, read the guide here on VJ for filing 1-130 and I-458 concurrently. You need to submit the I-130 (filled out by your husband) and the I-485, with all supporting documentation that is listed in the instructions for those forms as well as here on VJ. In addition, you might want to fill out the I-131 application for advance parole document (allows you to leave the US while your GC application is pending), as well as the I-765 form for Employment Authorization Document, which allows you to start working while waiting for the processing of your application.

For filling out all the forms, this website and ***removed***'s (just google the document name + instructions for example I-485 + instructions) form sections are really good. They both tell you exactly how to fill out the forms.
