Hi my name is lennybae and i have a question about if i can petition my family and i only have 10years green card on me but i been here in US for 3years? or can my husband petition my family since he is american? im just having trouble getting to work coz i am pregnant and i have a 1 year old boy and i think it will help alot if my family is here...thanks for all your help and i appreciate alot..

If you've been a GC holder for 3 years AND married to your USC husband for those 3 years you can apply for naturalization. Your husband cannot be the sponsor for your parents or siblings.

As a US Citizen, you can petition for your parents who are in the immediate relative category (same treatment as spouse, child under 21). You could petition your siblings but the wait time for that is about 10 years. Better off petitioning your parents, who can then petition your bro/sis (but if your siblings are over 21, then that might be just as long a process as you petitioning for them).

Anyways, figure out if you can naturalize and then move on from there.

your husband can't file for your parents or siblings. you will have to become a USC first.

how old are your siblings? are they unmarried, married.

NO,u can not petition ur parents unless u are a citizen.U need to apply for citizenship first before u are eligible to file a petition for ur parents.

Your husband can NOT petition for your parents,,it's only YOU when u become a citizen.

Your spouse cannot petition as they are not "his" family. You cannot petition because you are not a US citizen. If you become a US citizen then you can petition your mother, who will have an immediate visa number, and either you petition your sisters which would be about a 23 year wait for a visa number or, depending on the age and marital status, your mother might be able to petition them once she gets her green card.

Everything here is correct except sibling wait time. The OP is from the Philippines. Given the enormous amount of Filippinos applying for siblings to come over the wait time for them is around 22 years. They're currently processing applications from 1988.

my mom is 45 years old and my two sister is 16 and 17 years old..

i just heard when my sister turn 18 she cannot come here..

says who? not true, she can come at any age.

the difference is how long it will take.

because until you can file for your mother and she becomes a LPR and files for them. If they are under 21, the waiting time is not as long as if they are over 21.

or if they were married, your mother cannot file for them, unless she becomes a USC.
