My fiancé has been trying to get her Birth Certificate corrected for OVER 8 months. On her Birth Certificate, her middle name is spelled wrong, only the first letter is correct. She petitioned to have this corrected months ago and I even delayed sending my I-129F off to coincide with the anticipated date she would have a corrected B.C. in hand. That time has come and gone. Now every time she goes for updates on this issue, they tell her 3-weeks. What is going on!?!? Why is this taking so long?

In turn, this is delaying when she can get a passport! And she needs a passport for all of the things she must do when she receives the packet from Manila. I know I can expedite the passport, but I don’t know if we can expedite this issue with her birth certificate – which is necessary to have for the interview, correct? Anyone have any advice how to get NSO to hurry up and issue a CORRECT birth certificate (which we have been waiting over 8 months for)?

I got my NOA2 and it is valid through August 19th. I’m just afraid, at this rate, we may not get all that we need before we run out of time. She said the passport agency is letting her get a passport using some certificate she has that says NSO is working on fixing the error. But for the interview, I don’t think that certificate will fly – or will it? Meaning, if she doesn’t have the certified NSO birth certificate on NSO security paper, but she does have something stating NSO is fixing this mistake, will that be enough for the Interview.

Do you think I could contact the Philippines Embassy here and ask them to look into why it is taking so long for NSO to change 4 letters on her Birth Certificate? Please advise…

Hello! Did she file for the correction herself? I had problems with my BC too and not only a letter is missing but my whole first name and my parents' date of marriage was wrong too.For such problems I did not wait that long. I got my corrected BC in just a month and yes... in NSO secpa(security paper).NSO released a copy of my BC with amendments but with the BReN # missing.I was told it was because its not in their database yet.The reason mine was faster was maybe because our Local Civil Registrar(with $300 paytag) did everything for me .I got the certified copy like I said after a month but when I checked the signature from the Civil Registrar General was missing so I got a hold of them because I thought I was duped. It was genuine.Two months later I got a copy of the my amended BC with the signature and BReN #.So all in all it just took them 3 months to process, amend my BC and put in their database.

Corrections on BC doesnt require applicants to go to court anymore.It can now be amended without going to court following the passage of RA 9048. I dont think the Philippine Embassy would be able to help you with expediting its release.

I had the same problem i hired a lawyer right away got the new corrected birth in 8 months but it did cost a pretty penny to get it done that fast. lawyer is the only way to get it done fast

I just paid my local civil registrar $300 and I got an amended copy in a month on NSO secpa. With the BReN and everything it was just 3 months for me.But i have a friend who filed for it herself and got it in just 5months..

Corrections on BC doesnt require applicants to go to court anymore.It can now be amended without going to court following the passage of RA 9048. I dont think the Philippine Embassy would be able to help you with expediting its release.

You are correct. Clerical error correction of the Birth Certificate and other official documents can be done thu RA 9048. Here is the link primer on RA 9048:

Fee is I think P1,000.00 and the provided that you have all the supporting documents/papers as per RA 9048 requirement. Processing takes about 30 working days to complete as per NSO Ms. Lourdes Hufana. See response on my e-mail/inquiry:

Please be informed that the period for processing correction of clerical error takes thirty (30) working days at the least.

They told her 6 months in July of 2010! So I waited until November to petition her (I-129F). I figured five months from November, and she'd already have both a corrected birth certificate AND her passport. So now it's practically May 2011 and they still haven't corrected 4 little letters on her birth certificate! On top of that, we just got our NOA2 (Approval) on 4/19/2011, valid through 8/19/2011. So now we have to rush to get both and we're both kind of freaking out because we don't know why it's taking so long...

Ah she just sent me some text messages...

KRIS: oh ok, and certificate of finality means what? they're finally doing something?

mine was my not clear(penmanship)so i requested to LCR where i was born regarding my BC so in just 2 weeks i got my new BC.Then when i apply for passport the DFA saw that my birth place or the province where i was born was not indicated though the NSO confirms that my BC is ok but bcoz i cannot apply for passport whitout it thats why i apply again to our LCR and in just 2weeks i got my new BC again.You can process that quickly if you know someone inside to do your problem but its expensive.And this coz the delay of applying my passport and it took 50 days now to process the passport.

maybe she need help , because mine i fix only 3 weeks, my middle name is custodio but in my birth certificate is costudyo, i go back in my province and i go in municipality, after 3 weeks im back to NSO office and i get corrected birth certificate.

Welcome to life in the Philippines. Until you figure out the "correct" path, things just don't done, or don't get done right. And, beware of fixers and lawyers -- if it is not a family member, you may just find you are being taken for a ride.

It's either the hospital staff's error in typing it or the parents didn't check what was written in the birth record before they sign it and forwarded to the local civil registrar.

I got mine corrected in less than a month in Manila City Hall! and it only costs less than $100!:)I got the Certificate of Finality myself and submitted it to NSO Edsa, that way it could be faster and I got the corrected BC after a few days or a week...

my mom had issues with their names as well but they did not pay for $300 or $400 or she would have complained to me. I also had a misspelled middle name in my BC but my previous employer left it as is but they have me signed an Affidavit of Identity so I could use the name in my birth certificate.

$300 or $400 is ridiculous amount. that is red tape. i also think they are deliberately doing this. Philippine government almost sounds like a mafia.

Ah okay... Certificate of Finality, these are words I recognize! She told me the other day that she received a certificate of finality issued on April 25, 2011. And she said something about it saying that the decision on her petition has become final and executory. I had no idea what that meant. So how does this work from here? Because I'm not sure if I understand it the way my fiance is explaining it.

It sounds like the LCR has this certificate of finality also. So they have to send it to NSO Administration in Manila first, correct? And then SOMETHING will happen there. And from there they send some final documentation to NSO in Dumaguete. Am I right? It seems like it's being sent around in circles... But your post makes it seem like we're almost there! So if she has this certificate now, how soon do you think she might get her corrected birth certificate?
