VISA waiver or not?

Hello,

I was hoping to get some more information on the travelling to the US.

I am due to start an Art course in New York this June for a month, and I live in the UK. I have only just found out about this due to an internal error.

Unfortunately the university does not offer a I-20 form for for this type of course, meaning I can't get an F-1 student VISA. I have an epassport, and I am not staying for over 90 days which means I can qualify for the VISA waiver programme - but I'm not sure if I can enter if I am going to be studying? What do you think I should do?

Another problem - its bank holiday here and I need to pay my deposit for the course by the end of next week.

You might want to double check with the embassy there, but I am pretty sure you are not allowed to do any kind of studying under the VWP. You would have to apply for the B1/B2 tourist visa - that allows a visitor to participate in courses while here, although it does also have restrictions on the length of the classes and hours per week you are allowed to be studying while here as a tourist.

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

("Resident since" date on the GC is 07/20/2011

Sounds more like a holiday with an art course thrown in rather than a Student issue.
