Stepchild of USC from first marriage

Hi All,

It's time to file I-751 alreay. And I came across a question on the form already.

The form says to list "All Children".

I have a stepdaughter from my USC husband's previous marriage. I haven't adopted her, so she's not legally mine.

She's not quite his child either because my husband is only a non-custodial parent. We only have her 25% of the time.

So I didn't list her as our child when I applied for the conditional GC 2 yrs ago. But the wording "all children" implies that we should now list her as our child in the form. What should I do? I'll appreciate your advice.

There have been numerous discussions regarding listing children, all with various interpretations of this question. wacko.gif I (the green card holder) listed only my biological children and did not include my husband's (the USC) son from a previous marriage.

Good luck!

Thank you! I might do the same as you did then. It's always nice to see an example. I agree that they should be more specific as to whether they mean biological children or step-childern in the future.

That's what I did. Actually, it never even occurred to me to do it any other way because after all, what does my stepson have to do with my I-751?? Well, it worked that way. I got my greencard. :star:

Thank you, Stardust72! Yeah, I'll do the same. Hopefully, no question will be asked
