I recently filed in Chicago lockbox the petition for my husband hopely it will work out fine, i just received my 10 yr GC.

sent I-751 package 11-08-10

package received 11-10-10

payment cashed 11-16-10

received receipt & extension 1 yr. 11-20-10

NOA -notice date 12-1-10 received 10-6-10 biometrics 12-17-10 8:00am

Biometrics taken 12-17-10

mailed original divorce copy 12-17-10

Re-married 12-28-10

RFE-finger print cannot read - 3-25-11

Sent police clearance - 3-27-11

Production of card - 4-9-11

I'm sorry to say that if you sent all those forms, you filed incorrectly.

you mixed a lot of forms that you shouldn't have. It's unfortunate that you didn't ask here and check the guides on what to file.

If you are only a GC holder, meaning a LPR, the only form you can file for your husband is the i130.

you aren't elegible to file any of the rest of them.

the i129F is for fiance or spouse petition of USC filing for their fiance or spouse and will go through consular procesing.

the i765, i131 and i864 are forms to adjust in country, so you mixed forms for consular processing with forms for those who will adjust in the US.

As only a resident, your husband cannot adjust in country. The petition will take years and he will have to go through consular processing.

all those forms should not have been filed. It'll be rejected soon.

As only a resident, your husband cannot adjust in country. The petition will take years and he will have to go through consular processing.

agree with all that was said except the statement above. The husband can adjust if he is in legal status at the time when the priority date becomes current.

Correct. You should have filed the I-130 plus associated papers for consular processing. Once the papers were processed they would be placed in storage until his priority date comes current which is currently about a four year wait. Then the petition would be pulled from storage and the processing continues.

Best you can hope for at this point is they return everything to you without cashing the check(s) and you can start over the correct way.

To add, if he is inside the US and in status when his priority date becomes current, then you can file the I-485 and associated paperwork for him. If he is not inside the US or if his status is not current then he will have to return home and complete the processing there.
