K1 and CRBA

Hi everyone!my petitioner and I have a child and hes name is included on the petition.But then just recently we've found out about the CRBA law.And anytime from now well gonna receive our NOA2 and this may cause a delay in applying for k1 if i include my son to travel at the same time from my k1 application.So weve come to a decision with my fiance that I will just apply for k1 visa here in the Phils. Then at the same iam going to apply for CRBA after my interview on k1.

1)should i put on my DS forms that my son will follow to join?coz he will not travel with me to US at the same time coz of the CRBA?he will study here for the next school year.Could this plan will cause us problem in aplying for k1 visa?

Any insights,apinion and idea is well appriciated thanks!

Your son is a US citizen, and so he can travel to the US anytime. It is not suspicious for him to want to finish his schooling/ school year abroad at all, and then join you in 2012 when you are settled.

One thing to consider is that some US embassies will not give the mother a visa until CRBA is completed, but as you haven't gotten NOA2 yet, chances are CRBA will happen first anyway.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
