Hi,

I am getting married with my fiancee who is a US citizen. We are planning honeymoon abroad and obtaining a green card/travel permit makes it much easier for me to reentry into US. So following the advice from this forum, we went for a civil ceremony a few months ago, where only one witness attended. We have a few pictures from there.

We will hold a real church wedding with far more attendees in just two months away. Should we tell our immigration interviewer that we planned two ceremonies, and real gigantic is on its way, or should we just never mention it?

Many couples have done exactly this. My own wedding (by a Justice of the Peace with one witness) was on Halloween, and the ceremonial gig was on Pearl Harbor Day. The official marriage is the one that "counts." Tell anyone anything you want to about either.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

We're doing this as well. Right after POE we're getting married by Elvis in Vegas. However, it's important for us to get married by someone in our church, and we want to have a big wedding in Canada....so we're waiting till the following summer, when I will hopefully have my greencard, to have our "real" wedding.

I'm not necessarily telling them unless it comes up. I'm not going to hide it though either.

June 7, 2010 - Will asked me to marry him, and I said YES!!
October 4, 2010 - Will sent away the I-129F Petition
October 12, 2010 - NOA1 received!
October 15, 2010 - First "touch"
October 18, 2010 - Second "touch"
March 7, 2011 - NOA2!!!
March 18, 2011 - NVC forwarded our case to the Montreal Consulate....NOT where we wanted it to go!
March 25, 2011 - Email from Montreal saying that our case would be forwarded to Vancouver - only took one night for a reply from them smile.png
April 5, 2011 - Vancouver has our package!
April 6, 2011 - Received Packet 3 via email - now just waiting on my police certificate.
April 13, 2011 - faxed Packet 3 to Vancouver
April 14, 2011 - received Packet 4 via email
May 4, 2011 - Medical appointment
May 5, 2011 - Interview!! APPROVED smile.png


June 16, 2011 - POE at Blaine Peace Arch Crossing
June 28, 2011 - Got married by Elvis in Vegas!
Aug 8, 2011 - Received SSN in the mail.

Aug 31, 2011 - Sent off AOS Package
Sept 7, 2011 - Package received by USCIS
Sept 9, 2011 - Notice of Action email for AOS, EAD, and AP.
Sept 16, 2011 - Received my Biometrics Appt. letter for the 30th.

Sept 30, 2011 - Biometrics Appt.
Oct 26, 2011 - Received interview letter for Dec 1st
Nov 4, 2011 - EAD/AP approved
Nov 12, 2011 - Received combo card in the mail

Dec 9, 2011 - Greencard arrived in the mail!

Oct 18, 2013 - I-751 Package signed for at CA Service Center

Mar 5, 2014 - Approved! Awaiting greencard in the mail

Would you like to share what the interviewer asks about the two weddings, and what are the reactions?

I am just a bit concerned that this makes us look like we get married JUST for green card, and two weddings are over half a year apart, which looks weird...

Did you come to the US with a K1 visa? It's quite common for a K1 to have a civil wedding to meet the legal requirements of the visa, and then have a more elaborate wedding when they're able to make the arrangements. It won't look suspicious at all for a K1 to do this. For someone who entered with any other sort of visa it would depend on the totality of the circumstances.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

It's quite common for a K1 to have a civil wedding to meet the legal requirements of the visa, and then have a more elaborate wedding when they're able to make the arrangements. It won't look suspicious at all for a K1 to do this. For someone who entered with any other sort of visa it would depend on the totality of the circumstances.

I came here with another non-immigrant Visa, and my civil ceremony was in US as well. I guess we should keep it in a low profile then.

We sincerely plan to get married in the church, it's just that permanent residency grants us much more convenience to travel about and re-entry the US.

I also wanted to check, is your interview before the ceremonial, or after it?

I came here with another non-immigrant Visa, and my civil ceremony was in US as well. I guess we should keep it in a low profile then.

We sincerely plan to get married in the church, it's just that permanent residency grants us much more convenience to travel about and re-entry the US.

Two ceremonies might look suspicious, then. It would look like the civil ceremony was primarily done in order to satisfy the requirements to apply for the immigration benefit as soon as possible. This is understandable for a K1 because the requirement to marry quickly is imposed by the terms of the K1 visa, and it's understood that the K1 entered the US specifically for this reason.

The reason they will allow the spouse of a US citizen to adjust status while in the US is because it would be unnecessarily bureaucratic to require them to return to their home country for immigration visa processing. However, they don't want people using this method as a shortcut around the normal immigrant visa process. It's supposed to be an exception. What they don't want to see is evidence that this was planned prior to the intending immigrant coming to the US (preconceived intent), or evidence that the marriage was primarily for the purpose of obtaining an immigration benefit. When it appears to them that the timing of events was intended to satisfy the immigration requirements rather than part of the natural course of the relationship then the nature of relationship becomes suspect.

It's likely they're going to ask why you had a civil ceremony if you were planning on having a traditional ceremony anyway. If you respond that you had to the civil ceremony so that you could apply for a green card then you'll be denied.
