Hi everyone,

A quick question or two if I may concerning my wife who is a LPR from China. She sent in the I-130 forms for her unmarried son who is 25 living in Zhaoqing March 11, 2008 and was approved August 25 2008. What if anything do we do now? I assume his paperwork is still at the NVC.The way I understand it is, according to the processing timelines for an I-130 it is 5 months.Does it then get approved and sent to Guangzhao consulate where it sits for years until a visa number is availabl? At that time it arrives at the consulate will they send the beneficiary packets to fill out. Does my wife also recieve forms and be asked to submit more fees.Can anyone out there clear this up for me please.

The processing only takes a few months, but your step son needs to wait for his priority date to become current- the paperwork is held at NVC until then. Basically, because so many people want a visa as adult children of LPRs, there is a waitinglist. For adult children from China, they are currently working on May 2003, so your stepson has about another 5 years to wait before his interview and visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

no, it sits here at NVC for years until the priority date is current. yes, there are still more forms to file and paperwork to send. when the case is complete they will send it to the consulate and then they will send the interview date.

just wait until the NVC contacts your wife. there is nothing else you can do for now.

also, he can't marry unless your wife becomes a USC.

I thought you had to be an USC to be able to do that.

Of course it is - LPRs can petition for their unmarried children over 21, children under 21 and their spouses.

The only caveat is that the visa number is not immediately available, but involves several years of wait-time.

From visa bulletin: Family based second category and distribution of visa numbers:

Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:

A. (F2A) Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;

B. (F2B) Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation.

as long as he is unmarried.

LPR can file for unmarried children of any age.

you might want to check in with NVC once a month, you might have a nice surprise!

quotas were down these last few years (meaning #'s applied were far less than the country allocated totals)

so

some F2B's were moved forward.

There's been some retrogression, as well, based on country, but

call NVC, get a HUMAN, inquire if any movement on the casefile...

and

if the casefile is at NVC, please consider using NVC Electronic Processing (see the url in my profile)

like I said before, she will get nothing until the priority date becomes current. you have to check the visa bulletin every month

the second part of the process come after the priority date becomes current.

now, just wait and check the visa bulletin. For May, it's in 2003. Maybe in the future the bulletin jumps forward and it will take 3 to 4 years instead of 5. who knows.

NVC will contact her when the time comes.

packets are not sent, normally, from NVC unless you wish to wait the postal game, then it's 3 months per thing (DS-3032, I-864, DS-230). Most ppl here follow LingChe's Shortcuts - since this is a China-bound petition, can use the NVC Electronic Processing Guidelines on the Wiki section (see my profile for the URL). Mostly, people call NVC, pester a Human.

Also, can get some other speed via using the online payment portal - see http://www.visajourney.com/forums/topic/221785-ds-3032-slowdown/page__view__findpost__p__3560467 use the telephone to NVC soonish.

Also, no one wants to 'wait on packets' to be sent, instead ppl download the forms, gets ready. See
