Hi my dad is wanting to cosponser with my for my husband :) He is currently working has been all this year. Last year he worked a good part of that. My question is before last year he was only recieving disablity checks from ssdi. So out of these 3 years they want tax returns, hes only worked the last year 2010. What can we do about this? Also another silly question i am currently recieving food stamps for myself and two boys. I read that you can use like your free housing (section 8 i guess?) towards your income. So can you use food stamps and other benifits as your income? Thank you so much. And why do they want the latest 3 year tax returns anyway?

I think that as long as your fathers income was enough to support your husband for the past 3 years, he can still be your sponsor. Personally I wouldn't tell the uscis that your on foodstamps.

May 2005- Met my husband

June 2005- Became a couple

September 2006- 1st son born

July 2007- 2nd son born

June 2010- Married

September 2010-Hired our Lawyer

October 15th 2010- Petition Sent in

December 2010- 1st daughter born

February 7th 2011- Petition Approved

August 3rd 2011- recieved our appointment

September 1st 2011- 1st appointment- denied, but approved for a waiver

November 14th 2011- 2nd appointment, turned in waiver

_ _ _ _ _ - Visa Approved (still waiting as of February 18th 2012)

Reading the instructions for the I-864 you will see that if you were not required to file a tax return you (or any sponsor) would include a signed statement/affidavit explaining why they were not required to file a tax return for that year and cite the IRS rule.

For each of you (you and dad) this would apply to 2008, 09, and 10.

Housing received in place of salary can be considered income. Means tested benefits cannot be counted as income. I do not believe that section 8 housing would qualify. This I-864 FAQ may be helpful to you >> http://travel.state.gov/visa/immigrants/info/info_3183.html#6

Dad's current and ongoing income will have to be enough to cover his household size plus the intending immigrant. See the I-864P for those amounts. There is a link to the I-864P in my signature below.
