F1 case complete and waiting for visa # availability

Hi everyone!

I'm brand new to this forum and very confused about the whole process, but from what I've read into I fall under the category of F1.

I'll be travelling to the US soon to see my Dad and begin my application. I have no real idea as to how it works to be honest, it seems that everybody's application is different and I cant seem to find any definitive answers, anywhere!

When I start the application, will I receive any sort of visa number/card or anything of the sort initially (assuming I'm successful of course!) that allows me to work or live until the application is completely processed? How long does it take?

Assuming it is your Dad, that is gonna file the application for you and he is a US Citizen, then few personal questions first.

Are you married or not? if Yes, then you will be in F3 Category. If not married, then F1.

Are you over/under 21? If Over 21 and not married, Welcome to F1 Category. If under 21 and not married, then lucky you, you are IR1/2 Category and the whole thing should last less than 1 year.

And sorry to say, just starting the application for GC, does not give the work authorisation nor does it give you the Legal right to live there.

My name is Samir, I'm new here, my PD is June-22-2005.

I have a bit of a different situation, I am currently working in the US on H1B visa, I have already done my biometrics and interview before the retrogression. All my paperwork has been forwarded to the National Benefit Center. I'm not sure what to expect when my PD becomes current. Any information would be appreciated.

Like PatientMan said, you need to make sure you're in fact F1 (unmarried son/daughter over 21 of US citizen). After that, you will need to file an I-130 (a petition from your parent). The date they receive this will be considered your "priority date". Then you need to wait a few years until your priority date (PD) becomes current (i.e. a visa becomes available so you can process your green card). You check the movements of such priority dates using the Visa Bulletins (published every month at: http://travel.state.gov/visa/bulletin/bulletin_1360.html). Right now for F1 they are processing the cases from May 2005. So the sooner you and your parent file the I-130 the better.

Having an I-130 and waiting for the PD to become current does not grant you any kind of permission to live in the US. To visit or live in the US, you would have to apply separately for a different kind of visa (tourist, student, work, etc).

Guys just saw Mumbai Consulate has updated list for Interview Appointments for May 2010... 19 cases of F1 are there...

Hence we can estimate that there r still lot of guys whose PDs are in 2005 year....

In April PD jumped 8 weeks they had 39 appointments, in May PD jumped 4 weeks they have 19 appointments. Seems the demand is steady. I'm really hoping for a 7 week jump so my PD becomes current!!!

My understanding your PD is that date at the top of your NOA for I-130 petition.My mom called them to correct this and they told her to send a letter and attach copy of NOA. She did so and called and they said there is nothing they can do.I will call them myself however just wondering if this has happened to anyone else? I need some pointers as I do not have a good track record talking to customer service people no matter the company :)I would appreciate any feedback.

Check your I-797 Notice of Action form. Your PD should be listed there under Priority Date. Double-check that is says March 2006, call them again and ask where they got June 2006 from. I'm not sure about the other part of your question about the NVC timeframe. Good luck!

I Double checked my 797 and PD March 8, 2006. I will call them myself and inquire more about where they got June 2006.Since I just sent in my affidavit and visa application March 2012 and i wanted to know how do i know that my case is complete?Do I get a letter or email and what does it normally say?Just wanted to know what comes next.Thanks!

Yaa,,...we think that there r less applicants in year 2005..but the picture is sumthg different than we assume...

we think that members here r the only guys with PDs in year 2005 but there r still lot of applicants who r not member here but hav PD in year 2005....May be they must be unaware of these forum and discussion living in small towns or villages...

Coz last month there were total 39 applicants of India + 13 more of New Delhi Consulate....So total 52 applicants of India only....

Now PD has just moved 1 month and there r 19 applicants...New Delhi embassy has not yet posted appointments for May 2012...so the number still is not exact....

But i still hope there would be a lot more Visa Numbers left in this fiscal and our category move 2 months each month...i dont go for more but 2 months would be reasonable....

Probably we can see Jan 2006 in next 5 months i.e in Oct 2012 VB...Well i just hope, the picture can be different also....
