Is considered unmarried if the person applied when was single, and got married and divorced?

I applied for F1 (unmarried son...) in jun 2006

Now is my PD.

In 2008 I got married

In 2010 I divorced

I didn´t update my status.

I red that if I inform USCIS my case will convert from F1 to F3 but my PD will be the same as F1.

My PD is still the same? Will I get permission to go to USA now or will need to wait 3-4 more years?

Thanks in advance

Haljbr, I'm note sure what happens when one gets divorced or in your specific case. I guess you will have to show proof that you are not married. But try asking on the general forums and you'll probably get better help there. I think that you can retain your Priority Date if you switch categories, as long as the petitioner is the same. Good luck!

I searched some other forums and saw different answers, but none of them which were consistent, so I think the only correct answer might be from either a lawyer or directly from the NVC. There's the possibility that "unmarried" means "never ever married" as opposed to "married, then divorced."

Your application was from June 2006. Have you received a letter for your interview yet?

I don't want to encourage you to simply remain quiet about it, though that is one option, but you could run into trouble later on. The embassy might require you to provide them with a single status affidavit when you show up for your interview, which might reveal that you've been married, but divorced. It might just be possible that they'll consider your current status as still being unmarried, or say you should be in F3, which seems unfair. It's very technical.

My advice might be to find out from others in the general forum, as NevermindVz suggested, or to call the NVC and ask them a hypothetical question. If your case is already closed with them, it won't jeopardise you by asking.

Good luck! :-)

I get excited when you post because I'm expecting your post to say "I got my IL today!" :)

Last cycle the letters came out on the 27/28, which was the last Friday in the month. Possibly this weekend, too?! That would be so cool! These last two weeks have been SO long for me, because I'm really excited to see this month's letters coming out.

Who knows? They could surprise us with something at any time. My theory is that they already know what applicants will be current because it will be the last bulletin of the fiscal year. Maybe they'll send out earlier!

Fingers crossed!
