I'm getting mixed messeges about how to get my finace here from nigeria to us which form am I suppose to use and how long does this take and should just fly there meet the family and come back and not be married or be married and then file someone please help because this is very confusing :help:

Hi Lovehurts,

My first question is have you met your fiancee face to face yet? If you have met your fiancee face to face within the past two years then your are able to file for a fiancee visa (K1 visa) which you would use the form I-129f. Typically the I-129f is processed quicker (6-8 months) then the other option which it the spousal visa (8-12 months) where you would use the I-130. If you have not met your fiancee face to face within the past two years you will have to fly to Nigeria regardless of which avenue you choose or you will not be able to file for either. My husband and I juggled with this question and found we preferred to get married and apply for the spousal visa. We found that there were pros and cons to both options and choose which was better for us and our situation. I hope this helps. I hope I answered your questions. I would definitely suggest meeting someone before deciding to spend the rest of your life with them.(!) Both the fiance and immediate relative processes are long and expensive, but compared to the rest of your hopefully long and happy life it is minimal -- So as Inky said read up on the options as it isn't cut and dry. What works for one couple may not be the best option for another. I am going through the K-1 visa process but some days I wish we pursued IR-1 visa *sigh*

You can't start any paperwork until the two of you have been face to face together in real life. Nigeria is known to be the worlds hardest place to get a visa through. Are you Nigerian yourself ? Are you white ? Do either of you have prior marriages ? Is there a big age differences ? All these would make differences in what would be suggested for Nigeria. If you are very differnt in ages, you are white, either of you have prior marriages it would be difficult to be approved if you went over and married on the first visit. You should either visit and consider a fiance visa or make at least 2 trips and then get married and apply as husband and wife.

This will not be over quickly. You will not enjoy this.

Reading some of the comments here, I agree with them. WE are suggesting the following to you, keep in mind it is a suggestion only.

1. Go meet him in person first.

2. If you two decide that you are on the right track and things work out between you two, then come back and file for Fiance Visa I-129for him. But while you are there, meet his family, friends and etc. Take pictures, keep records of all your flights and ticket information and hotel etc. for later when you COME BACK TO THE STATES and file for his visa, you will need those as evidence of your trip and the two of you meeting in person.

3. you will need to file from here, not in Nigeria.

4. Once you come back, then you will need to follow the links that is being suggested to you here on VJ. The help is available when you need it.

5. Keep in mind that if you marry him on your first trip, from what we have heard, from other VJ members,the Embassy questions the quick hitch and they might delay things. But each case is different. That does not mean, you can't or should not get married, it is ultimately your decision and yours only to decide. But it is being suggested that you reconsider another trip before marrying your fiance.

6. Relax and take the trip first is my suggestion. Don't worry about what form you will need to fill until you come back. When you return to the States, then we will assist you with the next step. Keep in mind it takes time to do this, not just few months. You both will need to be patient and have faith.

I hope all our suggestions are helpful. Take care.

Meanwhile, we pray he is well and safe. PS if he is in Morocco? why not visit him there? instead of Nigeria? Just a thought for you not a decision.

Let us know how else we can help? But meanwhile, don't confuse yourself or overwhelm yourself with what is needed yet. Filing comes later,after the trip is done.

All of the suggestions mentioned here are great suggestions you need to take a deep breath and vist first as suggested because filing doesnt happen until you come back no matter what route you take. But you do need to be sure to gather documents along the way to start your evidence trail like what was mentioned by nigeramostyle. Also there is a bio form G325A that needs to be signed by the beneficiary(him) if you are filing K1 (fiance visa) not sure if that is needed for spousal someone can come along to clear that up for you I am sure. But I say that to say that if you are going to go the fiance route you might want to print that form and take with you to Nigeria or Morocco whichever place your visiting him in because he will need to sign that form so when you do file you wont have to wait with mailing him forms and sending them to him and him sending it back which would cause a delay in your filing. I hope you calm down and stop worrying because you do have a long road ahead of you and you need to pay attention to what everyone is saying because your case does in fact have some red flags that could cause the embassy to hassle you guys. I am not trying to be harsh but it is what it is when it comes to the Lagos embassy.....Good luck :thumbs: also all forms can be found on uscis.gov

he is ok i talked to him this morning but when the job that he is doing is over he is going back to nigeria morroco has too many issues when we did talk he said nigeria on't let him out unless he is married so this is bad and from reading the k-1 he has to be married up here not down there

FYI Nigeria might not let him out married either there are no gurantees either way.....also my husband 'got out' and we were not married we didnt marry until he was here........ :wacko:

I agree with patient2010, there are no guarantees either way, but my fiance is waiting for his visa, and there is a possibility there, others have gotten fiance visas in the past. With marriage there are no guarantees either. It is all in how strong your case is presented from here and there that would play a role on the outcome of your application.

The more you search for immediate answers the more you will confuse yourself. This is not an easy process, you will need to take baby steps before you can learn to walk, or run. You can't expect to have all the answers so early on in the process. Again, I suggest for you to go meet him and discuss this in person rather than on phone, emails or chat.

Here are your choices:

-Go meet your "fiance" (how can you be engaged to someone you have not met?) and take lots of pictures, save your boarding passes and proof of meeting. Upon your return to the US file a fiance visa petition (form I-129 F).

- Go meet your "fiance" and marry him there. Again, take lots of pictures, proof, and your marriage certificate back to the US and file the I-130 (petition for relative).

For either choice there are NO guarantees that the visa will be granted or that the initial petition will be approved. Lagos is one of the toughest consulates because it is very high in fraud -and you can take it from the other Nigerian members, not from me. Therefore, your relationship will be closely scrutinized:

Having met him in person only once before marrying him or filing for the fiance visa? RED FLAG

Race difference? RED FLAG

Age difference? RED FLAG

Religious difference? RED FLAG

Previous marriages and children for both? RED FLAG...

The list goes on...

Another choice would be to do various trips to see and be with your fiance before filing any petition. It would make sense, and it may be necessary to be successful at obtaining a visa. Also, consider that there are MAJOR expenses to this process and if you are not financially prepared for them it would be better for you to call it quits now before you realize you cannot afford the process midway! It is a long, expensive, and uncertain road ahead...

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

i am white he is nigerian i'm 47 he is 42 we are both chrisitans i have no children so when ever i see him i will have to see him 5 more times right
