Hey guys,

I have been married for almost 1.5 years, My wife applied for a k3 visa and the petition got denied, then my step-daughter was pregnant and wanted me to present while she is delivering, so i applied for a tourist visa and the consular kept asking me questions about my wife and didn't look at any document and told me that am illegible for a visa and that its gonna be hard for me to immigrate to the US, anyways my wife was here 3 times and the third time was about 2 months ago and she is pregnant now, she is scared to deliver here in Egypt so she wants me to try a tourist visa again. what is my chances ? also my wife is older than me by 21 years.

If anyone have any advice or help , please don't hesitate to tell me.

Apply for a spousal visa not the K-3 but the CR-1 / IR-1. Have you tried that?

Tourist visa will only let you in for a vacation then you have to leave. Plus you will likely never get one since your wife is pregnant and it screams intent to immigrate.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Hi I do not have any advice, all I can do is offer you and your wife prayers, which I believe is the best thing anyone can do for another person or situation. I am sorry to hear you are still struggling through this process. I pray soon you and your wife will see some kind of justice, from what I have seen your struggle has been long and hard. I wish you both the best.

I can't adjust status because am the father..i don't see why does it seems like intent to immigrate?

Where is your Step-Daughter?

your wife was denied on K3, now you are saying your were denied, but why are you applying for visa and which visa?

This post is just so confusing, your timeline says you are applying for CR1.

Ok Nevermind I had to re-read the orignal post like few times to understand what your were asking for.

Yes you will never be able to get the tourist visa - you might here some reponse on here to apply and try but it is not going to work. Since they already have on record your K3 was denied, CO is always goiing to assume that you will enter US and then try to do a AOS since they alreay know and its established that you have full intent to immigrate.

You will have to apply for CR1, thats the only option you have. You might have some tough questioning first about K3 being rejected not sure why that was rejected and second you might have some question about age difference.

Agree with Harsh, you are not going to get a tourist visa with a US wife and your history.

Applying for a CR-1 spousal visa is an option, but you'd need to find out exactly why you were denied first time. Are there any red flags other than age?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hey Sam,

Sorry to hear about your troubles.

You won't be approved for the tourist visa. Sorry to say, but it's hard for just about everyone to get a tourist visa from Egypt unless you have alot of evidence to show your ties back to Egypt. Plus since you have all ready applied a K3 visa, that shows you are wanting to immigrate.

You best bet is to keep on doing what you are doing to apply for the CR1 visa. Just because your wife is expecting and doesn't want to deliver in Egypt won't get you over here quicker.

i have the same case like u case sent back to uscis cuz of age diffrence and been waiting now for 10 monthes and no answer just we need to pray brother i emailed senator ,clinton , even obama but no answer there r soulotion i dont know if it will work or not there r web chat online in the embassy site on may5 they started to collect questions from now so just go put ur problem and me too and every one like us they might look at our problem cuz as u know refuse for age diffrence its illigal so i will pray for u my brother

Sam you have had such a hard time of it. Your chances of getting a tourist visa are about nill. Because you are married to a US citizen if you are allowed to come to the US you could file to adjust status from inside the US, this is why it will be denied.

You will not be allowed a tourist visa, since you are married to USC foremost. Has your wife applied for a CR1 for you, since the K3 was denied? Try to find out why it was denied. Wishing you and your wife the best and congratulations on the baby news. Best wishes.
