Any AOSers in Texas applying for a drivers license recently? I have a few questions, I went in to the dmv sometime last year to get a drivers license and was told to come back after i get my I765, after getting I 765 i went back and did the driving tests passed both parts and was given a temporary paper drivers license,2 weeks forward i received the card and it says visitors drivers license did anyone receive this same thing?or is it just me?

Does it still say the same thing when you get the conditional 2 yr GC?

There seems to have been some recent changes in Texas. When they made their big change 10-1-08, K1s were kinda excluded because the I-94 was for 90days and the requirement to get any license was at least 6 months remaining on the I-94. Same for learners permit and state id card. An EAD card showed a year allowed in the US, so that covered the over 6 month's rule. They would issue a "temporary visitor" license that expired the same day as EAD. With any kind of greencard (2 or 10 year) you could get a regular 6 year TX license.

Changes I've noticed to the chart LAWFUL PRESENCE REQUIREMENTS FOR ALL APPLICANTS (revised Jan 2011) are indicating that:

  1. A K1 can't get a license on the K1 alone (nothing new here)
  2. An applicant for AOS can get a 1 year temporary visitor license with just the NOA. (Don't have to wait on EAD anymore)
  3. A conditional permanent resident can get a temporary visitor license expiring when the 2 yr card expires or if removal of conditions has been applied for, the date of the 1 yr extension the NOA gives you. (Used to get a regular license for 6 years)
  4. A lawful permanent resident with a 10 year card gets a regular license good for 6 years.

Thats' the funny thing the expiry date on the visitors' drivers license is still six (6) years.

Well you never know how trained each worker/office is. My husband arrived the day the Oct 2008 changes were made and there was nothing like that document to clarify the specific visas. I talked to people in Austin and did a lot of research. I wrote letters saying they were leaving out K1s who did not have to leave the country after 90 days. K3's could get a license. He got his license with his EAD card and it was turned portrait orientation, marked Temporary Visitor, and expired in one year. There were lawsuits over the changes and the different license look because it called attention to aliens so was discriminatory in their view. I don't know how those turned out.

Anyway, with his conditional greencard he got a regular license, landscape orientation, that expired in 6 years. Then we moved and I changed my address online and got a new license in the mail. He wasn't allowed. More emails to DPS in Austin asking why, if he had already proved documentation in person, did he have to spend 3 hours to do it again just to change the address. They said their computers didn't captured legal status documentation.

Anyway, I don't have an explanation why a temporary visitor would get 6 years unless it was just a mistake. My mother-in-law hobbled into the DPS recently at age 91 and they renewed her license for 6 years. They are supposed to re-test anybody over 79. After age 85, they are supposed to renew for only 2 years if you pass the tests. Mistake on their part in my opinion to give her a new license.

So that's my personal experience with DPS. I was just telling what the document outlining immigration status says is supposed to happen.
