They grilled him in back room :( asked a lot of questions don't know all of them yet...he's in AP of course...but now they won't issue Visa until we can show my 18 yr old son doesnt' live with me..... and that he's 18... can i use the lease agreement showing proof of who lives with me, my sons drivers license showing his age dob and his address? the parenting agreement pages showing exact proof of child support documentation and who pays for what? please help me :(

I'm so sorry to hear that! All the docs u mentioned will work i think, and his school records that show his address maybe? I really don't know much about this....i will be praying for you. Hang in there!

Sorry to hear about the AP sad.gif but at least you are strong and you've been preparing yourself for this, knowing that you are working with a tough embassy. You will get through it!

Are they asking for this proof to verify that you have the correct household size on the AOS / to make sure your income is sufficient for the household? The suggestions so far all sound good to me. Does your son live with his father or on his own? You could also have him sign an affidavit saying he doesn't live with you, where he does live, and that you don't support him (if he lives with father, the father could also sign an affidavit, if willing). Having a copy of a utilities bill in your son's name at a different address might be helpful, or just any mail from an important source addressed to him at a different address. These are just a couple of ideas in addition to those already mentioned. Maybe some other people have suggestions?

Hang in there rose.gif

Yes he lives with ex still. He is giving me a copy of his drivers license and his bank statement. No they didnt question my income directly they want ti verify i dont pay child support or he isnt living with me from the sounds of it. I also have my lease saying its me and the girls. Im seeing an attorney today and he is drafting a letter outlining exacts on children and support and via nc law @ the age my son is

Also getting a letter from bank verifying that no child support is paid by me. Idk what else to do

his info shows his own address different from mine cos obv he doesnt live with me

This all sounds like pretty solid evidence to me. It should satisfy their concerns, since clearly your son doesn't live with you and you don't pay child support.

Really sorry this is happening to you... did they give any indication of the possible length of AP?

Knowing that AP was likely at your embassy, I think it's a good thing that they kept his passport... that seems like a positive sign to me. And if they said a month, it could just be a matter of weeks before he gets his visa. I hope it's really soon for you and calibob as well.

read page 7 top left and top right.... http://www.uscis.gov/files/form/i-864instr.pdf

it states that if a child is not 21 but has reached majority in the state/domicile where it is considered majority age and not claimed on taxes then they do not count on household... my sonis 18 and considered majority in NC and he doesnt even live with me and i have not claimed him on taxes at all so that shouldnt be an issue

then on the top right it clearly states that if we use child support it can be included as income as long as we have supporting documents.

did i read this correctly??

I think you read it correctly. I guess they are just looking for proof (or additional proof?) that he reached majority and you don't claim him as a dependent. If you already submitted this evidence, that is super annoying. Frustrating any way you look at it.

InshALLAH .... im picking up the info today from the bank, have my sons info already, and the attorney is adjusting the letter and scanning it to me as well as mailing so we can at least pdf the info to them asap...

they gave back originals keeping the certified copies we had for each one and kept his passport so i guess thats a decent sign.. i can deal with ap i guess thats a given... but i just think i sent too much documents they didnt read each line of the agreement easily i think... :( just have to condense the info and resbumit.

Thanks everyone for your prayers... this is so difficult.. i really miss him.
