ROC for K2 children after adoption by USC

I adopted my husband's children who came with him on K1/K2.

They derived US citizenship through the adoption and got a US passport issued.

My husband needed to file for ROC and we sent the package not including biometric fee for the children.

We got the package back, we still need to pay for the biometrics for the kids though they are already US citizens.

The first call to the information line, I was told they do not need to pay. So we resent the package with explanation about the call and no biometric fee. The package came back again (now we are 8 weeks behind the 1. filing!!)

The second call I was transferred to a supervisor and told that the kids still have to remove condition though they are already US citizens. If I apply for a certificate of citizenship I have to send in the 10-year greencard.

This is just rip-off!

We got NOA for my husband's application but we never got an extension letter for the kids though.

Just to inform anybody who is in the same situation.

How can you Remove Conditions when then the Children are now US Citizens?

You don't need to apply for Naturalization Certificates for the kids, just get them US Passports. Use the new birth Certificates and adoption paperwork to show that they are adopted children of a UCS.

That was my question to the supervisor too. But USCIS insists that they remove condition.

I know I don't really need a Certificate of Citizenship but down the road it will be easier for them if they have it. If not they might need to show my Certificate of Naturalization.

They birth certificate (Certificate of Foreign Birth) especially states that it is not evidence for the citizenship of the child or the parents.

I will apply for that one in a while. More money spend on immigration.

I'm glad I found this topic. I had a Q about this as well. I was also told that even if my USC husband adopts my daughter, we would still need to file to remove conditions.

I guess it's so that USCIS can update their records. Keep us posted, as I will be going through the same process.

06/01/11 - Submitted change of address online to USCIS. Mailed I-865 for sponsor. Neverending!

05/05/11 - Bouncing baby boy arrives

10/07/12 - Sent I-751

13/07/12 - I-751 NOA1

We did get the biometric appointment letter for my husband and the kids.

They already should have updated their records, we applied for an US passport for the kids and got this one issued.

I will keep you posted about the journey.
