The saddest thing that nobody else has mentioned is, what will happen to their child? After all, the OP does have a child with her husband and their divorce will also affect this child... It is one thing for people to act on their selfish desires, but a quite completely different issue is to do this when children are involved. I guess that since the child is a US citizen he/she has the right to stay in the US. I only hope the OP does not want to take the child back to Jamaica...

If OP still have a conscience and think about her child's future, maybe she can leave the child to her husband if ever she will return home. Her husband is still the father of the child so nothing to worry at all. I guess the father will still love and take care the child despite of what the mother did.

If the original reason for you coming to the US was to be with your current (soon-to-be ex) husband, and neither of you wants to be together anymore, then what is the point in you staying? You have more offered to you back home - I wouldn't want to risk being deported from day to day - and apparently you're worried about it as well. Unless, as others have posted, you came here just for the Green Card. The situation seems a bit shady. And as others said, unbelieveable; not sure I'd like myself very much if I were you. sad.

My marriage to my wife ( we have 3 sons) still existed in an strain manner until I was convinced ( by my girlfriend) to get an divorce from my wife

and file for her ( I secured us citizenship for our son independent of this) thus in DEC 2008 i was granted a divorce and I then filed a finance petition for

my girlfriend. things were well between us and finally she received her visa and we move to the us in July 2010. within that month we got married and continued the process up to the point she received her work permit and travel documents and SS number 3 months later.

That message was from the husband. The girlfriend (the OP) convinced him to get a divorce from his existing wife with 3 children? VERY BAD..........and later on, she CHEAT on him.

Jim, if her husband already filed for annulment based on fraud, doesn't that seal the deal about not being able to get a VAWA claim, if the petitioner is the abuser, shouldn't the person being abused be the one who file for divorce base on abuse to have a better shot for a VAWA claim?

Not if the divorce is still pending when the VAWA case is adjudicated. In most states, if you're determined enough then you can drag a divorce out for several years.

However, if the divorce is final before the VAWA case is adjudicated then there is a general requirement that the claimed abuse has to be a primary cause for the divorce. This is a sticking point that causes many VAWA self-petitioners to hold off on divorce until their VAWA case has been concluded.

I remember the other thread. The woman obviously doesn't care about their child or she wouldn't have let her new boyfriend hurt him. She needs to be deported and banned from ever coming back and the "friend" needs to be up on charges for battery of a minor. I don't have a lot of sympathy for the husband given he cheated on his first wife and had a child with this woman. But I have no sympathy at all for this woman who has lied and manipulated her way in to this country and then tries to scam the system to stay here. How dare you acuse someone of abuse and how dare you let your child be abused by your boyfriend. Go the hell home and never come back.

Since they both are posting from the same account, you'll don't know which story is the truth, so it is best that everyone stick to the question that was asked. Judgemental comments doesn't answer the question that was asked. We all needs to realize that there is always 3 sides to a story, his side, her side and the truth. That will be decided by the family court of law, and no one on VJ represents the Family Court of Law.

No worse than it is in Mexico. Plus people are doing this kind of action all of the world, that's why most countries have DIVORCE laws.

Immigration fraud is high in every poor country in the world. It's even higher if there's motivations beyond just poverty, like government oppression. Jamaica is nowhere near the top of the list in immigration fraud. Even Mexico isn't very close to the top. The only reason there's a lot of illegal Mexican immigrants is because we share a border with Mexico. Illegal immigration would be far worse if we shared a border with Nigeria or Vietnam.

lets just say both stories are true and she stole her account just like she stole poor ex wife's husband,if the guy is stupid enough to leave a woman of certain race to be with another woman of the same race,despite the fact that he has 3 children with his wife and a completely normal and healthy life,then he deserve this.they both do,if this is all correct,i just feel for their child
