My girlfriend is about to turn 20 years of age, and she is mexican. She was brought to the US when she was 10 by her father on a visitor visa. Her father came here on a working visa first, then brought over the rest of the family on visitor visas. I am US citizen, born and raised in New Jersey. I am a little nervous about my relationship with her because I am in love with her. The reason I am nervous is because I am just a little lost on what the possibilitys are for her to ever become a citizen. I'm not sure if I am posting this is in the wrong section but any help I would appreciate greatly. BTW she has gone through middle schoo, high school, and is now been taking classes at community college.

Actually someone that enters with a visa is in a lot better shape than someone that sneaks in immigration wise. Talk to JustBob he I think has one of the record overstays.

As long as she entered with a visa and was inspected upon original entry, she is eligible to adjust status if she becomes an immediate family remember of a USC - in other words, if you two marry. If she leaves the US before becoming a legal permanent resident, she will be subject to a 10 year ban, so she better not cross the border back any time soon.. But other than that, the overstay does not make her ineligible to AOS.

Are you certain she entered with inspection? Does she have the I94 still in her passport.

The other thing I would think about is, does she have a valid passport or that has been expired and if she has original i-94 still attached in her passport.
