Hi Folks

I just flew down to Dallas Tx. from Vermont to start truck driving school and promptly had to come home again because Texas DMV or (DPS as they call themselves) would not give me a CDL learners permit because I have less than six months left on my two year green card.

the thing is by the time I get home my one year extension letter should be waiting for me. My question is 'will DMV accept the letter

+ existing GC as evidence of current status and give me a License?' Theoretically they should but will they? Does anyone have any experience of using a 2yr GC with the extension letter when dealing with a DMV particularly Texas? Please advise.

And good luck to everyone here!!!

Your extension letter will be enough because it shows you have been extended for a period beyond 6 months.

From the Texas Department of Public Safety:

Commercial license requirements http://www.txdps.state.tx.us/DriverLicense/CommercialLicense.htm

Lawful presence requirement http://www.txdps.state.tx.us/DriverLicense/LawfulStatusDLID.htm

And this last document is the long list of all status categories and visas. See top of page 3 - Conditional Permanent Resident. They even say in the next section down that for adjustment of status applicants that an I-797 (NOA letter)is acceptable. So they list the NOA document by name and recognize an I-797 for that category as an accepted document. (Print that page to have your arguement with you in case you run across someone not familiar with the details.)
