Hello everyone. Ill give a brief background and then ask my questions.

My fiance, well, my wife now ;) entered on a K-1 visa on March 17th of this year. We were married on April 15th. I have our marriage certificate and we are now filling out all the paperwork for Adjustment of status. We are going to get her Social Security card issued using her Passport and Visa and our marriage certificate.

Questions:

1) On the forms for Adjustment of Status do we use her unmarried name or her new married name?

2) We can get her SSN card issued with just her passport and visa and marriage certificate before our AOS package is approved right?

3) Can she get a Driver license in CA with the SS card, marriage certificate, and passport with visa?

4) Since she did her medical in Mexico, how do we handle the vaccination thing? How do I find a Civil surgeon to do what is requested and how long does this take?

Thats all I have for now. Im sure more questions will pop up! Thanks everyone.

1. Well for us, we used my married name on the forms.. :)

2. All the stuff you said plus the birth certificate.. I got my SSN prior to marriage though.

3. I don't know about CA, but here in PA, you can get a license with your AOS NOA1, I-94, passport, marriage cert and SSN card.

4. Going to a civil surgeon or not is up to you, we had my records transcribed by a civil surgeon into a i-693 and then we sent the sealed one with our AOS packet. Ours took about a week because I needed a shot.

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

1. Use the name she wants to go by - if she wants to go by her married name, then put that on the forms.

2. Yes, but you need to go soon. Once you get to a certain point they won't issue it anymore until you get your EAD or green card.

3. This varies by state - in TX you need to have either the EAD or green card to get a license or state id, but someone from CA will probably know.

4. https://egov.uscis.gov/crisgwi/go?action=offices.type&OfficeLocator.office_type=CIV - call around and find out who might be willing to just do the transcription for a small fee instead of someone who requires that you have the entire medical exam done again. Once you find someone it should only take 1 visit to get this taken care of and they will give you the sealed envelope with the forms right there to mail in.

1. Since you got married in CA you had to fill out a marriage certificate prior to getting married. In the certificate she had to identify how she wanted to be known by after marriage. Please review the certificate to make sure to enter the correct information. NOTE: I am also in california and got married a few months ago. I decided to continue with my maiden name instead of using my husbands last name! In our case, my husband is the one that is adjusting and not me!

2. She should be able to get her SSN even before marriage but you need to make sure that representative at the SSN office knows about K-1 visa holders. Some representatives are not very educated on this scenerios

4. a) Does she have all the vaccinations required? You can find a local Civil surgeon by check the immigration website https://egov.uscis.gov/crisgwi/go?action=offices.type&OfficeLocator.office_type=CIV Each CS is different so you need to call around (In our case we knew he needed some vaccinations so we went to OUR doctor first to make sure he had all the required. Once that was done we went to a CS to transfer the vaccinations to the I-693 and went ahead with the medical exam [honestly the exam they did was like 2 mins - each CS is different] and they also did the TB test. TB results took 2 days and then another day for the forms to be ready for pick-up)

Since Mexico doesn't give a completed DS-3025 to K-1 holders, you need to bring your vaccination records with you to a civil surgeon that is willing to just do the vaccinations portion of the I-693. If the records are in Spanish, ask the CS if you need to get them translated, or they have someone that can read it. Only parts 1, 2, and 5 are required to be filled out for a K-1. You might want to find those instructions and print them out to show proof that is all that is needed for you. I know having them to show helped us out. Call around until you find one willing to do the transcription only, as many of them insist you need a new medical or the TB test again, which you don't.

Get any shots you have missing before going to the CS, or have the CS give you what you need still. Be sure to ask how much they charge for them though. We filled out part 1 of the I-693, printed it out and took it with us to the CS. They filled out part 2 (vaccinations section only) and part 5, sealed it in an envelope to send with our AOS. Ask for a copy of it for your own records too.

Hmmm, so the SSN office near us stated that since we got married that they can not issue a SSN to her. She said that she now isnt a K-1 visa holder due to our marriage.

Is this right?

They REALLY need to give people out here a set guideline of what to do step by step.

1. Enter the U.S.

2. Apply for your SSN card

3. Get married

4. Submit AOS package.

I mean come on, this is just not right to throw people to the wolves!

Yeah, they told her we have to wait for the EOD. They asked her if she was married and she said yes and they told her sorry you have to go through Homeland Security to obtain a SSN. She handed the person the paper showing that a K-1 visa holder is allowed a SSN and she still said they can not issue one.

I may try another office.

We were treaded almost the same way but before we got married. My husband tried to get a SSN about 2 weeks of being here and they said that he needed a EAD becuase the card is only used for work purposes and since he can not work no SSN! I showed her the paperwork and she was very firm on her statement. I was there and totally blanked out from being mad mad.gif and forget to request to speak with management!!!
