I hope you all have a very quick journey through NVC! My case number was assigned 3/24 and I might have had my case complete last week if I hadn't gotten (another) erroneous RFE.

Since you guys are just starting at the NVC, a little advice that I hope might save someone some time... don't assume that NVC workers actually understand the law! In particular, don't assume they understand whether the beneficiary is required to provide police certificates from countries the beneficiary might have lived in. For the beneficiary's country of nationality and country of current residence, the time period is 6 months; for other countries, the time period is 12 months. This information is correct on the "Documents the Applicant Must Submit to the NVC" page, but I got an RFE requesting a police certificate from the UK (not my husband's country of nationality or residence), even though he only lived there 8 months. The other day I finally got a supervisor to admit that this request was in error.

So if the beneficiary in your case lived in another country for more than 6 but less than 12 months, I would strongly recommend attaching an addendum to your DS-230 citing the regulation at issue - 22 CFR sec. 42.65( c)(1).

Also, if the beneficiary ever came to the US on a J1 visa, include in your IV packet proof that either they fulfilled the 2-year residency requirement or that the residency requirement did not apply. I didn't know about this when I first sent my packet in.

Sorry if this post is really boring and/or irrelevant, but for someone with a slightly "complicated" case like mine, this information could save you weeks at the NVC.

I suspect they don't realise that it's about our lifes, They should be more accurate when reviewing the files. I've also been a victim of several errors, first at USCIS and then at NVC. Been here since July 2010.The most frustrating thing is that we cannot complaint :bonk:, Just wait and wait and wait. Hopefully we're all almost there

Good luck

I'm sorry to hear about the delays in your case! I should stop complaining, since you have been waiting a lot longer than me. Here's hoping that we both get case completes/interviews in Paris very soon! smile.gif

Hi Kimsue,

Indeed it's been one of the most frustratings experiences of my life. And yes let's pray for an interview in the nearest future.

I kinda avoid crossing Concorde square in Paris (I live in Paris, my hubby is USC), I feel so sad not being able to even have the right to ask the Embassy to expedite the case,NVC had sent them our expedite request but they refused because they're too busy.

The operator at NVC told me that once they receive the packets to wait 20 days for CC, and acording to other VJ members timelines, I suspect is not 20 working days, but just 20 days, so Thursday 10 is the deadline. But then again we will have to wait some couple of week for the interview. I don't dare to prospect on dates anymore :bonk:

Since last week we also call the DOS, they are more accurate and precised then NVC operators, they really give you an update of your case.

Good luck

Question about the AOS packet:

I can't send the tax transcript for 2010 b/c I filed married and had to apply for an ITIN, so it isn't processed yet. I intended on sending a copy of the actually 10-40 and the W4s, but my wife and I actually submitted the 10-40 in front of an IRS agent in London so that we didn't have to send original documents but just had to show them. Since we signed and gave the 10-40 to the guy at the embassy, I don't have a signed copy of the 10-40. The question is: Do I need to have my wife print off a copy, sign it, and mail it to me so I can sign it as well and send it in, or is it okay to just sign it myself (not forge her name, obviously), and just write "Copy of filed 10-40" under that where her signature would typically go? Is that likely to generate an RFE? Every last thing about the copy is the same, just absent her signature. Thanks,

-Jim

Hi Jim. I don't know the answer to your question, particularly since the NVC can generate RFEs even if your documentation is correct- they seem to get easily confused. I do know that "actual" signatures on tax returns (1040s) are not necessarily required because the ones I sent in were e-filed and there were no signatures. I'm not sure, though, if the same would apply to your case.

I would recommend calling the NVC and requesting that the operator connect you with a supervisor. Definitely do not listen to any advice that a normal operator might give you on this issue, because I have had operators give me flat-out incorrect advice on more than one occasion. The only person I've talked to at the NVC who actually knew what they were talking about was a supervisor.

Since you just recently got your NOA2 you definitely have the time to have your wife print, sign, and send it to you. My NOA2 was March 7th and my AOS bill didn't show up until March 28th.

Sorry that I can't really help, but I hope everything works out for you. If a supervisor clears this up for you, I would consider creating an addendum to your AOS package that explains what the supervisor said.

I guess I'll join this thread too. I was approved April 18th but I have yet to receive a gosh darn case #. I thought the operators at NVC would be a little more organized but I've already noticed that they too provide conflicting information. One agent informed me that my petition was received by them on April 27th and that same day another agent said they received it on the 25th. Despite what day they actually received it I'm starting to feel that this is also going to be an unnecessarily long process.

Good luck to everyone here.

I got an operator today and got the "15 days" speech. I know I'm a bit early, but I've seen others get their #'s this early and was hoping I would too. Hopefully they just have some folks coming back from extended Easter vacations and will pick it up here.

NVC is saying 90 days now? When I called to get asst. numbers the operators were saying 20. It usually takes less than that though.

Oh, and the thread I think you're thinking about is for tracking your file from NVC to the embassy.

Holding my nose and jumping off the cliff.. hope I don't hit any rocks in the water.

I've been calling everyday and one day an agent told me it was received on April 27th...later on that same day another agent said it was received by them on April 25th. Before that they had just told me that they didn't see anything in the system and now they say they received my file recently but have not put it into their system. I guess if they tell you they've received your file you can ask them what date they received it.

Whatever you do don't give up calling because someone said it takes X amount of days. I'm pretty sick of hearing the "4 to 6 weeks" bs they feed but will keep calling 3 to 4 times a day until someone decides to finally generate a case # for my file.
