Hey guys, thought it was time to start a topic for NVC filers that got approved in the last few days and in upcoming May! Throw out a post if you just got your NOA2 or you're just starting NVC!

Hi! If you haven't gathered the stuff you need for the NVC portion, now would be the time! You need the last 3 years of IRS Tax Transcripts of the Petitioner (you can get those for free online, they get to you in a week or so), a letter from the petitioner's employer on company letter head with his/her start date and salary, etc., pay stubs, all the same stuff from anybody thats joint sponsoring the beneficiary if the petitioner doesn't make enough to cover the costs, then you'll also need:

Two passport-style photographs (2X2 inches) of the beneficiary. (Write down NVC Case# and beneficiary’s full name and date of birth on the back side of both photographs lightly)

Completed and signed form DS-230 Part I by the beneficiary

Completed and unsigned form DS-230 Part II by the beneficiary

Photocopy of the beneficiary's passport biographic data page

Original/certified copy of beneficiary’s birth certificate

Original/certified copy of beneficiary’s and petitioner’s marriage certificate

Original police certificate(s) of the beneficiary

Original/certified copy of military record, if applicable

Original/certified copy of divorce decree, death certificate, etc. of previous marriage, if applicable

Most important, we need to start calling the NVC to get our case #. Don't wait for them to get in touch with you, call (603) 334-0700 daily and put your NOA2 Receipt # in, until you get your case #, then we go forward from there!

I have a silly question on the I-864, for the petitioner's income. I am the petitioner, and according to USCIS 125% of the poverty level for a household of 2 (me and my spouse, the beneficiary), is 18,387 (http://www.uscis.gov/files/form/i-864p.pdf). I currently make more than 3 times that, however, I have only held this job for 4 months. The prior year I was unemployed, though I earned well over that amount none-the-less. The year prior to that (2008 tax year) I was employed and earned significantly more than the guidelines as well. Does my period of unemployment and my short tenure at my current position jeopardize our I-864 application? I have a cosponsor if need be, but I don't want to confuse the application by unnecessarily submitting a co-sponsor if I don't have to.

If you were over the guidelines the last 3 years on your tax filings (adjusted gross income) than I would not look for a co-sponsor. Get a letter of employement, last 2 pay stubs and last 3 years tax transcripts and you are good to go.

4 days after AOS cleared and still not IV bill.

Question about the AOS packet:

I can't send the tax transcript for 2010 b/c I filed married and had to apply for an ITIN, so it isn't processed yet. I intended on sending a copy of the actually 10-40 and the W4s, but my wife and I actually submitted the 10-40 in front of an IRS agent in London so that we didn't have to send original documents but just had to show them. Since we signed and gave the 10-40 to the guy at the embassy, I don't have a signed copy of the 10-40. The question is: Do I need to have my wife print off a copy, sign it, and mail it to me so I can sign it as well and send it in, or is it okay to just sign it myself (not forge her name, obviously), and just write "Copy of filed 10-40" under that where her signature would typically go? Is that likely to generate an RFE? Every last thing about the copy is the same, just absent her signature. Thanks,

I hope you all have a very quick journey through NVC! My case number was assigned 3/24 and I might have had my case complete last week if I hadn't gotten (another) erroneous RFE.

Since you guys are just starting at the NVC, a little advice that I hope might save someone some time... don't assume that NVC workers actually understand the law! In particular, don't assume they understand whether the beneficiary is required to provide police certificates from countries the beneficiary might have lived in. For the beneficiary's country of nationality and country of current residence, the time period is 6 months; for other countries, the time period is 12 months. This information is correct on the "Documents the Applicant Must Submit to the NVC" page, but I got an RFE requesting a police certificate from the UK (not my husband's country of nationality or residence), even though he only lived there 8 months. The other day I finally got a supervisor to admit that this request was in error.

So if the beneficiary in your case lived in another country for more than 6 but less than 12 months, I would strongly recommend attaching an addendum to your DS-230 citing the regulation at issue - 22 CFR sec. 42.65( c)(1).

Also, if the beneficiary ever came to the US on a J1 visa, include in your IV packet proof that either they fulfilled the 2-year residency requirement or that the residency requirement did not apply. I didn't know about this when I first sent my packet in.

Sorry if this post is really boring and/or irrelevant, but for someone with a slightly "complicated" case like mine, this information could save you weeks at the NVC.
