K3 Still Alive!!!!!!!!!!!!

The NOA2 for our I-129F (K3) was approved the same day (April 14th) as our I-130. Fortunately, the I-129F (K3) was received yesterday at NVC and approved TODAY with a Case Number already assigned and NVC told me the paperwork is already on its way to the U.S. Embassy in Manila through DHL. I would imagine that means Marielle will be called for an appointment once they have our paperwork in hand and since its still only the end of April, she could still possibly have an end of May appointment??? Regardless, NVC told me the K3 is still alive and well since it was approved first and already sent out. We will still have to do an Adjustment of Status once she gets to the U.S. and it will be more expensive but at least it might be quicker this way and you can't put a price on being together sooner. Looking for feedback from anyone who is familiar with this type of scenario and can comment on how things play out from here. For example, what will happen from this point on and possible time frames for each step?? Any help given to us to help us understand this complicated situation will be very much appreciated.

P.S. Our I-130 was just received at NVC today and not even entered into the system or has a case number yet.

So, to be clear, your I-129F arrived a day ahead of your I-130? Was a case number assigned to the I-130 already?

It appears USCIS is now sending the petitions separately and holding the I-130 a day or two before forwarding to NVC. This is the third such report. I'm trying to determine whether to conclude USCIS has instituted a new procedure that revives the viability of the K3 visa.

As for your spouse's K3 visa process, you've got some more paperwork, a fee to pay and a medical to do but you're probably looking at a July interview.

Ok, so now its the weekend and I'm thinking since our I-129F was processed and given a Case Number and then sent to the U.S. Embassy this Tuesday, April 26th, and our I-130 is still sitting at NVC without being scanned for a bar code for processing or even a Case Number yet, I would imagine the K3 is gonna be the way to go for us if we want to be together sooner rather then later. I know it will be more expensive this way with having to do Adjustment of Status in the U.S. as opposed to having it already done before she gets here but you can't put a price on being together and being able to start your life together. Can someone please just tell us exactly what happens from here as far as what should we expect next and how soon can we pay our VISA fee of $350 and set up an Interview Appt? Will my wife receive something like a packet or something in the mail sometime next week or do they call her or what? Please give us some details on what happens next once our Paperwork reaches the U.S. Embassy, of which might have already happened by now.

We really appreciate all your help relative to our strange case of the K3 going through instead of the I-130. I went to the Manila Embassy website and found the packet form. Generally how long will it take to get to my wife since it our paperwork left NVC on April 26th? Can we pay our VISA fee ASAP and the schedule an interview ASAP? We would love to get something lined up for June 1st or 2nd because my wife just updated her Philippine Passport but will not receive it in hand until May 18th. She can then go for her Medical on June 19th and even if that somehow takes up to 2 days, it will be plenty of time for a early June appt. It says in most cases you can "schedule" an interview but not actually "have the interview" unless you have your a Valid Passport good for at least 6 months.....is that correct??

We have two big family gatherings coming up in my home state of New York and one is for June 11th and the other for July 4th. We desperately are trying to get things done so she can somehow be here by then. Her Criminal Records check is already complete and she seems to have all her paperwork complete by our Immigration Lawyer. She just needs to get her Medical and pay her VISA fee. Please advise when you get a chance and thanks again for all you do for us.

With a lawyer involved, I can't be sure just what your procedure will be. Sometimes the packets are sent to the attorney. To shortcut anything, you'll need to bypass the attorney getting the packets.

Passport must be valid for 6 months past the date of interview.
