Hi everyone,

I came to the USA under K1 visa. We got married in the USA within 90 days as requested. We applied SSN, ID but temporary ID and it's expired in Dec/2009 (my old name, not yet changed to husband name). My I-94 is expired in Dec/2009, K1 visa is expired in 11/2009. We also let the form I-693 in order in 11/2009. But we couldn't afford to apply AOS until now. My question: Is it still fine for us to apply AOS as instruction now while my I-94 expired? We haven't yet let documents needed to prove common residence in order. We need to do that before we send the AOS package to the USCIS? When it's done, we send it together with AOS package? Or wait until for the interview? I can't find any step tell us to prepare the proofs...

Please give me an advice. Thanks so much!

Just summarizing the I-485 APplication instructions for you. On the first page of the instructions it states that you can apply to adjust your status if you were admitted as K-1 visa holder and got married within 90 days. (SO YOU ARE OK IN THIS PART AND CAN APPLY FOR I-485)

However, on the second page under "WHO is NOT elligble.." part D states if your authorized stay expired before you applied.

It also states on part F that YOU ARE NOT ELLIGIBLE IF YOU FAILED TO MAINTAIN YOUR NONIMMIGRANT STATUS ... UNLESS you are applying because you are a K-1 who married the US citizen petitioner within 90 days.

According to the instructions on the I-485 you still qualify to apply to adjust your status. It is upto them to approve or not but as far as i can tell you can apply. Read the instructions carefully, watch the forums to get more ideas and send in your package as soon as possible.

I am not a lawyer and i do not know the laws but this is what i would do if i was in your shoes.

I have been on F1- status for about 6 years and am undergoing AoS. Everything else has been smoothly for us so far ( gotten biometrics letter in the mail just 11 days after mailed out ). My appointment is this Friday, just wonder how long it would take for the EAD or GC to come back after the appointment. I am working and don't feel comfortable with the situation.

I understand I can file with my married name, however, my name is Ka Ki Chan(Briggi is a american nick name that is easier for people to call me) Ka Ki is my given name and some of the doc i have here are either named Ka as first name Ki as middle name or Ka Ki as first name & no middle name.

My DL and Marriage Cert have Ka as first name Ki as middle, but my passport, visa, i-94, & i-20 have Ka Ki as first name. I want to change my first name so bad because I hv use Briggi for 8 years and everyone knows how to speel my name.... but briggi is not my legal name. . .and I dont have any legal doc proof that I am Briggi (beside some e-mails or Facebook acc)

so.... should I file

1) First: Ka, Middle: Ki, Last: husband's last name, or

2) First:Ka Ki, Middle: None, Last: husband's last name, or

3) First:Kaki (combined), Middle: Briggi, Last:husband's last name, or

4) First:Kaki (combined), Middle: None, Last: husband's last name, or

5) Fist: Ka ki, Middle: Briggi, Last: husband's last name, or

6) First: Brigggi, Middle: Ka ki/Kaki, Last: husband's last name.

Which one(or two/three) would you suggest me to use without causing any problem?

07/01/2010 - NSC received my RFE respond

07/09/2010 - EAD card in production

07/19/2010 - Approval notice sent

07/21/2010 - Received EAD card

*(About 8-10 soft update during the I-765 process)

07/30/2010 - Applied first SSN & changed last name

08/03/2010 - SSN available in SSA system, name changed on Driver License & auto insurance

09/14/2010 - AOS package sent via priority mail(w/o I-765)

09/16/2010 - AOS package was delivered at Chicago Lock Box

09/22/2010 - Check cashed, received receipt # via txt & e-mail.

09/25/2010 - Received NOA receipt notice for I-130 & I-485 in mail

09/30/2010 - Received Biometric Letter

10/13/2010 - Biometric appointment (Done as appointment time)

This may have been answered in another thread (I feel like I have seen you asking this question elsewhere....) but just in case - you can't file with anything other than your legal name. So Briggi cannot be used as any of your names at this time.

As for using Ka or Ki as your middle name...since you have documentation in both I would think it would be how you WANT it to be on your GC. Either way is probably fine. If you decide in a few years to become a US citizen you can change your name at that time to Briggi :)

I hope someone can give me advice, I have recently married my husband, he is from England. He came into this country legally six years ago but his visa has run out and is now here illegally. How can we change his status? Does it make it difficult since he is now illegal but came in legally?

I'd appreciate any help to these questions i have about applying for adjustment of status:

1)) My wife is here on a K1 fiance visa, we were recently married before the 90 day period. We're putting together all our paperwork now and I'm just wondering if we need to send in the I-485 only or if the I-130 is required as well. Its an extra $355 dollars to apply for the I-130 and I don't want to make that mistake. Ive been reading and I don't see anything/anyone making a strong point on VJ that they are both required, they both ask for many of the same documents as well.

2) I read alot of posts and feedback about the medical examination on this website, most of which is kind of old. My wife delivered the envelope with the medical exam at the Point of Entry. Does USCIS have this process together enough that we just need to fill out part 1 and send it in. They should have the medical exam, right? Yes, it was done within the last year (six months ago) and we do have a copy of the DS-3025.
