The irony of proving you had no intent to marry and remain in the country while on a tourist visa has struck me.

I had no intentions to remain in the US, and didnt even know of hubbys existence until I was here. It never really concerned me to prove this, as I knew it to be true. However, of course I am now seeing that I am going to HAVE to prove this. But what do I have in order to do this? I do not have a return plane ticket, as I wasnt sure if I was going to stay for my whole visa year, I do not own property in my home country as I lived with my parents, and how do you PROVE that you didnt know a person?

It strikes me that if a person did commit fraud and entered on a tourist visa with intent to marry and remain, they could in advance set up some 'proof'. Such as buying a return ticket, but not planning to use it.

I have no evidence of anything- I did not think to keep anything as I had no idea I would come to need it. And here the irony lays.

I guess all I have is the hope that truth prevails........

Yours is quite atypical from the vast majority of people that arrive on tourist visas and remain and are faced with the prospect of demonstrating that their intent was not to do so when they used a non-immigrant visa to enter the country. You had a one year visa and would normally not be maintaining such close connections with your homeland for a period of 12 months. Whereas, a tourist planning a visit for a period of 60 days, would not likely sever all ties during that time frame. I'm not syaing it never occurs, but its less likely. On top of that, it appears did not marry until close to the end of that stay. Where it gets tricky to adjust and overcome any suspicion of prior intent, is when a marriage occurs within a matter of weeks of entry or it appears that plans had been made in advance to do just that.

Many VJ members have done the same thing as you are describing with no problems at all.

You may not even be asked about it at your interview, but if you are, all you can is be honest about it and tell them exactly what happened.

It is up to every individual doing the interview whether they believe your story or not.

Good luck for a successful interview.
