hello you all,

I am well in to my journey now since 1999 , I just filed 130 485 and what not it is accepted and waiting for interview.

here is my concern I have a 15 year old from previous marriage he lives withe me.

When we filed I only listed him on the application ones that he is with me and want him to get adjusted too ( no extra 130 or so)

now i want to know how is going to be treated on my aos ,does he come to the interview too ? he not mentioned in the noa so what do I have to expect ?

You're being petitioned by a spouse? Your son will need a separate I-130 other wise he's just there. He will attend the interview too.

if your wife is filing for you, she must file a separate petition for your son as his stepmother.

just by putting his name on your petition is inoformation only. he has not been petitioned.

she needs to file an i130 and he will have his own interview.

Yes, he needs a separate petition and separate fees. He will not get derivative status from your I-130.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

my son is here on a E2 depended with me do I still have a separate petition for him ?

that's the type of visa he came to the states.

the petition is from his stepmom, so he needs a separate i130 and the rest of the forms.

well I filed the rest with the i 485 and put him on there put all birth-certificate and passport from him with it ; except not a separate I 130 .

I wonder if the INS is going to contact me about it ? or should I call them and resubmit ??

there is no need. it will be considered as information only.

there is no petition for him, unless she files an i130. of course you will need to resubmit everything you sent with your petition.

he needs his own i130 and i485, own medical exam and vaccination, etc.
