I didn't see any serious threat to the person being beaten. Yes, it was a two or three on one fight, but it wasn't as bad as it looked. The dude standing in between them didn't get hit at all and the old lady walking up to them didn't get hit either. They smacked the "girl" around a bit and kicked her, dragged her by the shirt, but I didn't see anything too threatening.

That "seizure" at the end didn't look like a seizure. It looked more like a "I'm so crazy I'm shaking... stop hitting me."

Prosecution of what? The girls beating the other girl?

McDonalds most likely trains their employees (like every other company out there) to NOT intervene in customer altercations. You can see one of the employees standing between them but he doesn't do much more than that. He's most likely following his training yet still doing what he can to help. In all seriousness, he could probably get fired for doing too much.

There's no legal requirement for anyone to call 9-1-1 at anytime.

Yet normal behavior in urban areas.

What's really disgusting is this sort of thing happens in our society and it's no big deal. Every day something like this happens in the cities and nobody cares until it's on YouTube.

Your obviously not a Cop, District Attorney or Judge. The man in the video was prosected and may face time, for what beating a kid.

So the lady that tried to intervene caught a punch but declined medical assistance. OK. She didn't get punched too badly then. That's not a felony.

Still not seeing the felony anywhere.

That (the punch to the lady trying to stop the beating) would still be an assault. As to the beating of the primary victim you see, well you don't but the video shows, a series of assaults, going away, coming back into the McDonalds for fresh assaults, deliberate kicks to the head etc. I would say beyond simple assault, intent to cause grievous bodily harm.

Felony charges are a distinct possibility. Possibly added bonus if charged as a hate crime, likely depends on what the assailants said before, during, and after the multiple assaults took place.

Whats most stunning about these incidents is the lack of meaningful help offered from bystanders, in this case, some of the McDonalds employees seem entertained and the guy shooting camera-phone encourages the assailants to flee before the police come.

This is what kills me about 'hate crime' status...why would it matter what the motivation was, the beating was just as brutal. And in order to do this to another human being, one has to have hate in one's heart.

I loathe this 'special status' that is the hate crime label. Judge the sentencing on the brutality of the crime itself, not what was said.

Cos let's face it - if that's how we judge a hate crime...let's say a person hates gays. Attacks a gay man, but doesn't say anything. Does that mean it can't be proven as a hate crime? Could the assailant then say 'oh we fought over something else' and that's it? That's a pretty easy way to evade this hate crime escalation. Conversely, if two men get into a fight and one of them happens to be gay, but it's not relevant to the true reason they got in a fight, would that make it a hate crime just because the victim was gay?

Looking at that vid, I don't care what the reasons were...that is barbaric, and should be punished to the fullest extent possible

You loathe it because you think it means something other than what it really means and seem to believe in euphemism like 'hate in your heart'. That's meaningless Hate crimes are not trivial and the US legal system doesn't 'grade' the status of the victim in order to prosecute the crime. The biggest problem with the legal system in terms of fairness is that poor people get very much worse legal advice than rich people.
