I was just wondering if anyone could help me out with a question about whether my fiancee petitioner (as US citizen) can travel abroad while our i-129F is under initial review? She's finishing school and wants to travel during the summer overseas (she's not coming to see me, I live in Canada), is this allowed? I know that I cannot leave my home country. Thanks!

Of course the petitioner can travel. The USC can leave the US at any time. Being admitted into a foreign country is up to the specific country however

Good luck

PS - umm...why can't you leave your home country? Do you have a flag on your passport preventing you from traveing internationally?

thanks so much for the quick reply! I was flagged last year as a result of a TN visa denial. I was just thinking that it probably would not be a good idea to leave Canada until my K-1 is approved unless I have a REALLY good reason to do so (I do have employment and a permanent residence here in Canada). Will that flag affect my fiance visa?

No, as long as you disclose and are truthful about the flag and the denial, you'll be fine

Good luck

She can travel anywhere anytime she wants for any reason...even to see you.

Make sure someone checks the mail for any RFEs or something that may come.

It will not affect your fiance visa. You can travel anywhere you want at any time you want. If you come here to visit, just bring evidence you will return.
