I don't think that being authorized for employment is the issue, I think the issue is having a document issued by USCIS that indicates that the person is in the country legally. For a K1 the I-94 doesn't do that, it generally expired or about to expire for a K1. A Receipt Notice for an adjustment application is sort of a nebulous open-ended thing, and quite easy to forge, whereas an EAD is a picture ID, much harder to forge, and has a defined period of time.

Also an EAD is more 'universal' than an NOA - more types of non-immigrants who are going to be in the USA for an extended period of time (thus unable to drive on a foreign license) than adjustment applicants are going to have them.

Just idle speculation ....

Oh, and I don't think that an EAD is necessarily necessary - it's just that an EAD is something that Ks pending adjustment can easily get that makes the DMV people happy. There are possibly other things that would work also, but Ks have learned that EADs work, EADs are easy to get (albeit expensive and time consuming), so an EAD is what they think to provide in terms of USCIS documentation.

I agree, that just sounds silly! I mean, since when must you be able to be employed to drive? But I'm sure, buried somewhere deep in code 98343984334 section 98389&^aszZ.p you'll find a reasoning.

Personally I find the idea of EAD being necessary to be stupid. Since when was being allowed to work here directly correlated with your legal presence? The whole idea of being legal to work and having a drivers license needs to be decoupled, as they are completely unrelated. People need to drive whether they work or not.

I saw the end of an item on MSNBC this morning. The topic was repossesion of autos for default on the loans, I think, because they were showing film clips of cars being towed.

Anyway, a closing comment was that statistics show people are more likely to go into default on their mortgage than on their car payment. One explaination given for this strange prioritization was that one can sleep anywhere on a couch, but a couch cannot get one to work. (I'll add in support, nor can public transportation other than in a few large cities. On the other hand, it's far easier for a lender to foreclose on a car than to forclose on a house, so I think that's a more likely explanation.)

Its annoying, but people seem to equate drivers license with the ability to work. ....
