Has VSC passed me by?

Hi all,

This is my first time posting on here, I wish it could be more upbeat, but

it is depressing at this point.

First let me say that I am happy for those November and December VSC filers

getting there NOA2's, I wish that no one has to wait months.

That being said, they got my I129F on 10/12 and have not "touched" it since 10/22.

I can understand some variation in approval times, but seeing people getting

there NOA2 that filed up to two months after I did seems a little unfair to be

honest about it. Really, what is up with that?

I have been waiting almost 6.5 months now. I do not even see much movement

any more before that second half of Oct. I have barely moved down Igor's list

this week, even though there was a lot of NOA2's entered. I see others around

my time period, but I do not know if they did not get there NOA2 yet, or if they

are just not entering there NOA2 into VJ.

Is there anyone else out there that has filed in the first half of Oct. that is

still waiting for there NOA2?

Before the 5 month mark, it was disappointing seeing that I would be waiting that

long. After the 5 month mark, it was a little depressing waiting longer, but at

that point everyone in my time frame was still waiting, so it was not so bad.

Now after the 6 month my depression is deepening as I see that most of there

activity is after the date I filed. And now my depression is turning into real

frustration and anger at the system.

I just keep checking my email and the USCIS site all the time, but every time,

just a disappointing nothing from them. The longer this goes on it is just

grinding me down, and my fiance is convinced that it will be a year or longer

till she gets here. All this is just bringing me down, I am even having problems

sleeping now.

Ok, guess I mostly needed to vent, as I know no one on here can really help

my case. But I would like to hear if there are still people out there that

have filed in the first half of Oct. that are still waiting?

I just want to let anyone who is about to reach 6 months processing at 6 months or over 6 months that you can ask for expedited processing.

Here is how I did this and how it happened for me

When I reached 5 months I called and inquired about my petition they put in a service request for my case to which 15 days later I get a response which explained what I could do when I reached out of the normal processing times

So here is what happens, they post normal processing times on their web site your NOA1 date is your posted date

When you reach the normal posted processing times based on your NOA1 you have to allow USCIS an additional 30 days for processing

If the USCIS has not processed your petition during this time you can call the USCIS and ask for a expedite request

If the Agent you speak to does not let you file the request ( their system may not let the agent put int he request ) so ask for a tier 2 officer

When talking to the tier 2 officer please be nice and answer their questions and tell them that you want to request and expedite based on ONPT ( Outside Normal Processing times ) This is following their procedures and is not jumping ahead of anyone else as you have already met the requirements

Then the same day or following day you should receive an e-mail from the USCIS which is asking for a letter and evidence for the reasons why you are requesting an expedite and that you have 20 days to respond

I wrote a simple letter following their requirements to include certain information and then explained why was I was requesting the expedite and they provided a fax number and I faxed it back as quickly as I could which was the following Monday the 4th

Today I received a letter stating that I met the requirements for special handling ( this was after I was actually approved but confirms that I was processed because of this request )

List of events

3/1/11 called reached 5 months & a service requested was entered

3/16/11 received response back stating about 30 additional days processing to be allowed etc ( where I got the ONPT information )

3/31/11 called USCIS and asked for expedite with a tier 2 officer

4/1/11 received e-mail for letter to respond

4/4/11 faxed back letter and evidence ( letter, 1st service request, expedite request, and noted processing times on USCIS website )

4/8/11 received text & email notice of Petition Approval ( petition approval was 4/6/11 no notice till 4/8/11 )

4/9/11 received letter from USCIS stating that I met the requirements of special handling

Good luck to anyone who is about to reach 6 months processing times
