Well it has come time for the Interview, and the waivers. Problem is I think we will have to address the Moral Turpitude issue within the i-601. Problem is I can not get a clear idea if that will be the case or not. He did dumb stuff when he was 18 twice. Also since the Dutch will not release this information to NO ONE except for the interviewing consulate we couldn't prepare ahead of time. So what constitutes Moral Turpitude? I found this.. http://en.wikipedia.org/wiki/Moral_turpitude But I am not sure if that is correct or not.

The link seems very acccurate in it's description especially pertaining to immigration matters, however it does not necessarily mean that the consulate will inquire or red flag him. Just be prepared to answer truthfully and be able to explain clearly without saying too much.

Hi Nina..my husband was denied a visitor's visa in 2009 and the reason they gave was a crime involving "moral turpitude". However, we aren't sure which conviction the officer was referring to because he has several "stupid things" on his police record from when he was a young rebel. We think its one offence labeled "grievous bodily harm" in the UK but not sure what that translates into US law. It was a fist fight but my husband accidently broke a guys jaw. I spoke with an immigration attorney after the denial and he said that the officer may have felt that multiple convictions is moral turpitude (not having good moral character) not necessarily a particular offence. He also stated that it is entirely up to the officer who interviews if a visa will be issued and it depends on the type of visa applying for if there are any options such as an I601 waiver. So in our case the officer may have felt that "grievous bodily harm" was intent to cause serious injury, but did he know or was he planning on the guys jaw breaking? No...it was self defense because the other guy threw the first punch. Moral Turpitude is a shady term that has no clear definition because from what I have read, it is only used for US Immigration purposes, and although they follow the INA laws it is really an opinion...in my opinion anyway! lol...good luck

Start reading around page 33.. this is attorney speak but you get the lowdown on what the law is. Read case studies on appeals on CIMT cases too to get a better understanding of how this stuff actually plays out in practice.
