Uff, is my lawyer wrong?!

Okay, I just got an email from the Naples consulate saying that they received my approved petition from the NVC and they attached the package 3 to the email. Now in this package three, there are two forms: The DS-230 and the F Supplemental Sheet. My lawyer (well her paralegal) says we do not need to fill out these forms because they are for immigrant visas only and the k1 is a nonimmigrant visa. UFF what do I do?

IF you are chasing after a K-1 visa, the DS-230 PART I must be filled out.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

Some consualtes do use the DS 230 for the K-1 visa since it is an intending immigrant visa. Kiev, the consulate we used, does not use this form. If the instructions say they do, then fill it out.

I guess I do not see the problem though...it would take much less time to fill out the form than ask the questions here or to your lawyer and sort out conflicting answers. WHEN IN DOUBT...FILL IT OUT!

No penalty for filling it out if you really don't need it.

Not if you go through the Kiev consulate. They do not use it. The DS-230 is, in fact, designed to be used in conjunction with immigrant visas which the K-1 is not. But many consulates do use this form. The answer is not "yes" or "no". The answer is "Depends on the consulate"

Agreed. Not sure why people hire lawyers for clear cut cases. I've seen time and again how lawyers just **** so much up and give wrong answers to basic questions that are answered on the consulate websites.

Any 'real' lawyer would know everything regarding a case, whether its criminal, immigration or whatever. The lawyer and paralegal in this case are plain lazy in my opinion and aren't worth the $$.

An attorney who isn't aware that many consulates require a DS-230 (part 1) in response to packet 3 is either not primarily an immigration attorney, or hasn't handled many K1 visa cases. If the former then they should do their research before answering any questions from their clients. If the latter then I would guess the number of K1 cases they've handled can be counted on one hand because I would estimate more than half of the US consulates require the DS-230. In either case, an attorney who is either not knowledgeable or not experienced should be providing services pro bono, or at least at a substantial discount. A client shouldn't be expected to fund their on-the-job training.

I could forgive an attorney for not knowing about the DS-230 for either of the reasons given above. However, if the beneficiary did, in fact, receive one of the consulate's standard K1 instruction packets, and not an immigrant visa instruction packet (as some consulates have the nasty habit of sending to K1's), then I'm surprised the attorney would even suggest that the beneficiary not follow the consulate's instructions. Advice like that can have disastrous consequences.
