Adjustment status application rejected because of minor mistake

Hi! Can anyone tell me, if my application for adjustment of status was rejected, because of a typing error, can we re-send the same forms, or do we have to print everything out again and send those? (There was a mix-up in two numbers in the zip code, and my husband signed the I-130 in the wrong space.) All of the forms have seem to be runned through some kind of scanning machine, so all of them have typing on their right sides. Would this still allow us to re-send the same forms? Thank you for your help!

Why would you think it has been rejected? Have you heard anything? If there is a problem they will send you an RFE

Signature in the wrong place will result in the whole package being rejected.

If the mistake is only in the USCIS forms, you might as well print out a new form with the mistakes corrected. I doubt that it will make a difference one way or another, even if you used the same forms.

Thank you everyone for all the answers! I assumed that it was rejected, because they attached an I-797C, Notice of Action form with all my documents, and on it says under Notice Type that "Rejection Notice". They also informed me that I can return my application after the corrections have been made, so it's not a rejection based on content. I assumed that we'd have to print out those couple of forms with the correct information, but I wasn't sure about the prints on all the papers... They are just not too specific, and I didn't want to make another mistake and be rejected again. Also, I would like to ask whether I need to have my birth certificate translated, or not. Although I sent the copy of my b.c. in without a translation, they didn't mention anything about it on the I-797C. Shall I still go ahead and have it translated?

Ours got rejected for not using the correct forms.....sounds like yours was sent back in the same way ours was. All we did was correct the mistake and set in right back. (with the same evidence from us with the processing printing they put on the paperwork)

Am not sure about your birth certificate but am guessing from the things I have read you need to have it translated.

On I-485 instructions, under "general instructions", it says:

"Any document containing a foreign language submitted to USCIS shall be accompanied by a full English language translation which the translator has certified as complete and accurate, and by the translator's certification that he or she is competent to translate from the foreign language to English."

So yes - translation is needed, if the original is not in English. With the certification. Some people have translated their BCs themselves and just attached the certification stating that they are fluent in the original language of the BC and English.

Signing in wrong places is not a minor mistake

Signature in wrong places would make the document totally useless, and cannot be used for any legal purpose.

But either way you fix it and can send it back or you use new forms and send it back.

You need to translate the birth certificate and also attach a certificate of translation. Anyone who speaks English and Hungarian can do it, no need for official translation. If you need I have a copy of how it looks when the Orszagos Fordito Iroda does it.

I don't know how your BC looks, but mine is in French and every line has an English translation, so I sent it without any translation, got an RFE ( although I know other people on this forum and around me that had no problem doing that). Anyway, the IO told me during the interview that it was a mistake on their part because the person sorting through the papers did not pay attention and that what I could do to avoid that is make 2 copies, highlighting the English translation on one of them.

Also just to be on the sdafe side, I would have a friend or family member translate that if I was you, because although a lot of people translate themselves and provide certification, if your IO is like the one that looked at my case, she said that if something needs to be translated it has to be someone other than you. Again some IOs won't mind others would. So just to be on the safe side and avoid possible RFE, I would have someone else do the translation

bbutterfly: my BC has no English in it at all. I guess you are right, and the best thing is if I just went ahead and had it translated with somebody instead of doing it myself. By the way, can't believe that they made a comment that you 'provided too much evidence" (I read it on your timeline info), when they also advise us to attach every kind of evidence and documents we have. Anyway, I'm happy for you! And thanks for the advice!
