Any Ideas, NVC Nightmare

I am asking if anyone else has had these issues and know of any good ways to deal with them. After submitting both an I-130 and I-129f and taking 8 months to process it finally got to the NVC, both of them. Since both got there they administratively closed my I-129f so that was useless. This now means that the only consulate in Canada that handles the interview process is in Montreal, on the other side of the continent of where my wife is at. The problem that I'm having is that I submitted all of the paperwork that they had asked for but they still came back after 20 business days saying they needed more information that wasn't asked for before. So now I'm going to have to wait another 20 business days for them to process this. Is there anything I can do to get my wife into the United States, not working just living, and finish the process here. Going through this process I won't see her on our wedding anniversary, yes this process has taken over a year to process.

Sadly, this is the process. It's difficult for many people who live so far away. I know while my I-130 was processing, I attempted to cross the border to visit a number of times and was lucky to go across, I would stay for about a month and then come back to Canada. Is your wife able to visit? I know for some it's harder b/c of the travel distance/work. So sorry you're having troubles! Just know you're ALMOST there!!! After the interview you're home free!

Last time my wife tried to cross she was given a sheet of requirements for her to cross the next time. This was several months ago. The problem that we have now is that she recently became unemployed due to the recession. I had asked her to not get another job because it would be unfair to an employer this close to getting approval. Now she can't prove without a doubt that she is going back to Canada after her visit so she will be rejected at the border. This time is starting to put an even larger strain on our marriage, imagine being away from your spouse for a year. I'm willing to still go through the process but this far away for this long is insane.

Does anyone know if I try to call the USCIS or a Consulate in Canada if I could plead my case and ask for permission for her to cross, even it it is for a month.

Everyone on here will tell you that she is allowed to cross any time. It just depends on the border guard on that date. I NEVER was asked to prove that I was going back! I of course had student loans, and a rental agreement showing that I had ties back to Canada. I also showed round trip flights that I was coming back.

Sorry about what you’re going through but I think it’s the standard way NVC office works. Whenever they request additional information or you ask a question the can take up to 20 days to give a reply. I just went through the something with my husband’s application.

Our wedding anniversary is in June and believe me I wish my husband were going to be here, but it doesn’t look like it. He didn’t make the list for interviews for May and the way the NVC office drags their feet he probably won’t be placed on the June list either.

I’ve talked my congressmen and house official and there nothing they can do at this point to speed up the process. I was told we just have to wait.

I wish you look and allot of patience that we all need going through this.

The short answer, no - your wife cannot live in the US without a visa

She may visit but as someone who was denied entry, it will be exponentially that much harder for her to be admitted.

If she lacks the ties that the POE said she should have, then I am not sure what else you can do. Can you visit her?

We all know how terrible this process is and I am sorry.

Does she have ANY other ties? enrollment in school? a lease/mortgage or utility bills?
