Timeline

Well folks so i asked my wife to get her passport copy notarized and apostille... well when she went there to get it done at a government office they said they haven't even heard of apostille well finally when she found someone who would do it... the officer said they used to do it but not any more... he specifically said

"They don't want to take RISK by apostilleing it" this is so frustrating...

I dont know what else to do... i guess i will have to give IRS a call to them tomorrow and see if i can explain them the situation...

in a meanwhile i asked my wife to send me a her drivers lic... lets see if i can make some copies and get it notarized at the local bank and then send it in...

well if not then i guess will have to file my taxes as "Married filing separately" and then amend it once i get her to come over here... and once i have her SS#...

Do anyone of u know... how this will work out...

well i did send in my AOS packet with form 1040 filled "Married filing jointly" but once i file my taxes as "filing separately" what do i need to do...

I will call NVC tomorrow to find out if my AOS was accpected or not... lets see what happens....

Read all of posts about the ITIN application unfortunately after i got the rejection notice from IRS..

I had sumbitted

1. notarized copy of birth certificate

2. notarized copy of marriage certificate

3. notarized copy of birth certificate

As seems to be the case, none of the notarized nonsense seems to works.

I have unfortunately sent my wifes birth certificate for DS-230 and dont have the original to submit. Would just a voter-id or another government photo ID (i.e. PAN-TAx card?) work ?, alongwith a plain photocopy of the passport?

I will try to enquire with the wife if she has other true copies of her birth certificate, but if that doesnt turn out to be so, I am screwed.. :bonk:

alternatively.. how hard is it to get an Appostille in India? any idea?

For me it was the difference of getting 200 dollars to 2000 dollars back. That was a real no brainer haha. I had to just send copy of her passport, with certified notary and apostilled.. I didn't send apostilled document originally and had to have her redo passport. They gave another 60 days but this was all they asked for...

for 2010 I applied for a ITIN number for my husband. He is from Mexico. They asked for the following passport, Matricula(mexico id) and Birth certificate. All had to be notarized. My tax preparers also wanted to send a copy of my marriage certificate but it wasn't needed. Being my first time claiming my husband I didn't get my taxes until 2months and 3 weeks.

May 2005- Met my husband

June 2005- Became a couple

September 2006- 1st son born

July 2007- 2nd son born

June 2010- Married

September 2010-Hired our Lawyer

October 15th 2010- Petition Sent in

December 2010- 1st daughter born

February 7th 2011- Petition Approved

August 3rd 2011- recieved our appointment

September 1st 2011- 1st appointment- denied, but approved for a waiver

November 14th 2011- 2nd appointment, turned in waiver

_ _ _ _ _ - Visa Approved (still waiting as of February 18th 2012)

If you cannot get the ITIN or it is too frustrating to continue...why not just amend your taxes when your spouse arrives in the USA and is assigned a SSN? You have three years to amend your taxes, and surprisingly easy to do so.

For now...File married filing separately, put NRA for the SSN...you cannot e-file, but will have to mail it in.
