Timeline

Hi

we are about to send our AOS package in tomorrow.I have a few questions, just to make sure we are on the right track

1) Do we have to send it to Chicago? I am confused about where to send it, we live in Denver, Colorado

2) The Civil Surgeon who gave me shots today (which still hurt by the way) put my I- 693form in a sealed envelope and handed me a separate sheet of the vaccine records with it, do I need to send this sheet in with my package or is that for me?

4) how do we label the whole package? should we just write "Adjustment of Status" or something like that??

3) there are only two months left on my K1 visa, the average time for AOS getting approved is 4 months, what happens between the time my AOS gets approved and the time my k1 visa expires?

Send your application to Chicago. Dont worry about the K1 expiring....as long as you married before the 90 days your gold. When you get your NOA (notice of action) hold dear to that. That paper is your proof of application for the AOS. We waited a couple months after the 90 day mark and had no issue what so ever with the AOS. Good luck and double check everything twice.

In addition your K1 visa expires as soon as you enter into the US, so it has no baring on your being out of status. It is recommend that you file for the AOS before your 90 days is up but it is not a absolute.

Yes you send to Chicago follow the guidelines here and on USCIS.

The sealed envelope goes in with the I-485 and all your paperwork and make a copy of the vaccine record ok and keep on for you and send them a copy too.

You don't need to label anything put all your papers together with paper clips and have a front letter on paper saying whats included in envelope. Make a list of what you have and write that on the paper "to whom it may concern" then the address of Chicago office and what is included i your paperwork. Follow the list on here.

Your K1 visa expired the day you arrived in USA it is a one time only visa and you married within 90 days so you re fine just out of status right now but you are filing AOS so you have nothing to worry about.

1. Payment(s) as required by USCIS. Be sure to include the payment for both the I-485 and the biometrics fee*. Use a personal check so you can track the payment. Money Orders are also accepted.

>> The fee for I-485 applications filed on or after July 30th 2007 inlcudes the cost of the I-131 and I-765 (no need to pay for them if filed with or while your I-485 application is pending adjudication -- as long as you paid the "new" rate for the I-485 effective July 30th 2007). 2. Cover Page. This should include the applicants contact information, a description of the benefit being filed for ("Immediate Relative (Spouse) Family Based Adjustment of Status Application") and a table of contents listing the major items in the packet. If you need additional room to explain your case, attach a separate sheet and list the attachment on the cover sheet. Make sure to sign and date the cover sheet. 3. Form I-485: Petition for Alien Relative 4. Copy of the non US Citizen Spouses Passport (biographical page as well as entry stamps). 4a. Copy of the non US Citizen Spouses K-1 or K-3 Visa from Passport 5. K-1 Visa Holders: Submit Copy of NOA2 "Approval" for I-129F **

K-3 Visa Holders: Submit Copy of NOA2 "Approval" for I-130 6. Copy of the non US Citizen Spouses valid I-94 (front and back copies) 7. A copy of the intending immigrant's birth certificate along with English translation. (If in any language other than English) 8. A copy of your marriage certificate. Note: While a regular copy is allowed, submitting a certified copy is preferred as some members have received an RFE asking for this (so if one is available use that instead). 9. G-325A filled out, signed and dated. 10. Two passport-type photos (see specification) of the Non US Citizen Spouse. Write the full name and A# on the back using a soft felt tipped pen or pencil. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the G-325a. 11. I-693, Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. Only if your DS-3025 is marked "incomplete" is a I-693 required to be completed. If it is marked as such (incomplete) you are required to complete certain portions of the I-693 and have a Civil Surgeon certify the form (and seal it in an evelope). Specifically, you will complete Part 1 (Information about you) of the I-693 and provide both the form and your DS-3025 (if you have it, proving your vaccination history) and any proof of required vaccinations that were completed prior to entering the US. If you do not have a copy of your DS-3025 you will need to provide sufficient evidence of your vaccination history to the Civil Surgeon (talk to the civil surgeon's office to discuss what vaccination records they accept as proof). If you do not have proof of your vaccination history the Civil Surgeon may insist on re-administering all the required vaccinations prior to completing the I-693. Once the Civil Surgeon has has verified that all required vaccinations have been performed, they will complete form I-693 Part 2 (the vaccination section) and Part 5 (the Civil Surgeon's Certification). They will then seal the form in an envelope and return it to you. 12. I-864, Affidavit of Support (see poverty limits here)

>> Include any additional required supporting documentation 13. I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)

My Journey:

We met through a study-abroad program in Shanghai, China in August of 2009

We got engaged March of 2010

I received my K1 VISA in 6 months (June-December 2010)

We were married 04/02/2011
I received my conditional 2-year greencard (AOS) in 2.5 months with no interview (April-June 2011)

Our son was born 02/03/2013

I received my masters degree in Speech-Language Pathology 04/17/2013

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

The AOS guide is flawed, in that a personal check should be sent for tracking purposes. This is counter-intuitive, because USCIS prefers guaranteed funding to rapidly continue your process. Think about it: as if your were on the receiving end of your petition. A Bank teller/cashiers check (guaranteed funding) or money order versus a personal check (they need to hold your file until the check clears). Which case would process faster?

When you send your AOS package, concurrently filing form G-1145 (notification of AOS acceptance via E-mail and/or SMS text) will give you the assurance that your submission was received.

If you are paying your fees by check, please be aware of the following:

  • Electronic Deposit of Checks – If you are paying your fees by check to the cashier, we will convert your check into an electronic fund transfer. When you hand your signed check to the cashier, we will scan your check and retain it. We will then use the account information from your check to make an electronic fund transfer from your checking account for the amount of the check.
  • Insufficient Funds – Please note that the electronic fund transfer from your account can occur faster than normal processing of a paper check. If we cannot complete the electronic fund transfer because your account has insufficient funds, we will try to make the transfer up to two more times. If your account still lacks sufficient funds, you will be billed the original check amount and a one-time administrative fee by USCIS.
  • Authorization – By presenting your check to the cashier, you authorize USCIS to convert your check into an electronic fund transfer. If the transfer cannot occur for technical reasons, you authorize us to process the copy of your original check through normal paper check procedures.

Basically personal checks get authorized and processed electronically at the point of receipt and the case is presumably not held up. Files are "accepted" with the proper form of payment in placed in queue unless the payment "bounces" which happens immediately (eCheck process). The files are processed in the order (roughly) they were received regardless of payment method.
