Hello All

My husband currently resides in Mangalore, and I had just applied for his ds 230, but we got an RFE on question 30. Anyways, we have sorted that out now and will soon be re applying the ds 230 again. One question I had was my husband is planning to come here anyways in May on B1/B2 visa since he has to attend some interviews for a job. so few question I had was

1. Is it ok to travel on B1/B2 after we have sent in the ds 230? (He has been here twice after his I 130 got approved so Im guessing this should be ok). Can somebody please confirm?

2. My main question was in order to avoid going back to India again just for the GC interview can his interview location be changed to an embassy here in the US? Currently his interview location is MDR since his case number starts wtih MDR.

Kindly let me know.

Any input is appreciated!!

1. quick answer, no guarentees that he'll be admitted into the US

2. another quick answer - no. The United States does not contain any US embassies or consulates. He started the process abroad and he needs to finish it abroad

Good luck

sorry, no US Embassy in the USA, so impossible to interview for a CR-1 VISA inside the USA.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

No and no. you're already at the NVC stage now. You have already sent in the RFE evidence that was requested, correct? so now you just have to wait a few weeks till you get case completed and on to interview. I'm guessing that if the RFE was not that serious and just something routine, then you shouldnt have any issues and you will get case complete and interview. basically you have about 2-3 months to interview. just wait it out. I'm surprised though that the I-130 got approved with him alreayd having a B1. I always thought that once you have a pending immigrant petition like a cr-1, then a tourist visa was a big no no. interesting. anyway good luck!

I would say "probably" and no. If he's come and gone already twice since the petition was approved, there's no reason to think he won't be admitted again, just no guarantee. Of course, he'll need to interview for ANY visa from OUTSIDE the country he wishes to enter. It's a visa interview, not a green card interview.
