Change of Address

I arrived in the US in October 2009 with a K-1 visa. My AOS was approved on March 29, 2010 and I received my conditional green card on April 5, 2010. We lived in Santa Monica back then.

My husband and I moved to Glendale in May 2010. We didn't notify the USCIS about that change of address.

In March 2011, we moved again to Monrovia, our present city. We intend to stay here until I become a US citizen or for at least 2.5 years.

We will apply for my ROC (I-751) in January 2012. I wanna file for change of address (AR-11) this month and these are my questions:

1. On the form AR-11, there's a portion that says "Last Address." Should I write the address that the USCIS has, the one in Santa Monica, or our real last address, which was in Glendale?

2. The same form states, "Failure to report change of address is punishable by fine, or imprisonment, and/or removal."

Could I get a penalty for not changing my address when we moved to Glendale and instead just update it now when we've moved to Monrovia?

3. Does my husband have to file I-865 although my AOS was completed a long time ago?

I will certainly appreciate anybody's help regarding these questions.

Agreed. Just fill in the forms truthfully. We filed the change of address forms late and there were no problems.

Tell the truth. No need for an affidavit of support when removing conditions.

An I-865 is not an affidavit of support. It's a change of address form that must be filed by any sponsor who signs an I-864 as long as the original affidavit of support is still in effect.

File both forms - the AR-11 and I-865. Failing to file the AR-11 within 10 days is considered a misdemeanor, but USCIS and it's predecessor INS had a long history of not enforcing INA 265. This changed after 9/11, and they began enforcing it much more strictly. However, it's far more likely they would charge you under INA 265 and 8 USC 1305 if they caught you after having NOT reported your new address than if you simply report it late. I've never heard of anyone being prosecuted and deported for an INA 265 violation alone unless they never reported their change of address and were caught by ICE.
